CITY OF ALAMEDA RESOLUTION NO. 8708
APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3634, AUTHORIZING
EXECUTICN OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS
THEREIN, APPROVING BONDS AS TO SUFFICIENCY, AND ACCEPTING CERTAIN
EASEMENTS, ACCESS RIGHTS AND PARCELS OF LAND (HARBOR SAY ISLE
ASSOCIATES, SUBDIVIDER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, there
has heretofore been filed with and approved by the Council a Tentative Map of that certain proposed
subdivision known as Tract 3598; and
WHEREAS, said Council has approved, heretofore on January 18, 1977, a revision of a
portion of this tract, now being subdivided as Tract 3634; and
WHEREAS, Harbor Bay Isle Associates, a partnership comprised of Doric Development, Inc.,
a California corporation, and Bay Farm Island, Inc., a Nevada Corporation, subdivider herein, has
presented to the Council for approval a Final Map of that proposed subdivision known as Tract 3634;
and
WHEREAS, said subdivider has entered into an agreement with the City of Alameda to
construct and complete the public improvements in said subdivision and to post with the City Clerk
of the City of Alameda bonds to guarantee full and faithful performance of said work and a bond to
guarantee certain improvements for a five-year period, all in accordance with said Article; and
WHEREAS, said Final Map delineates thereon certain easements and a parcel of land
designated "Street Dedication" dedicated to the public; certain access rights for the purposes of
lagoon maintenance and operations of public safety vehicles and emergency equipment dedicated to
the City of Alameda; and a certain parcel uf land designated as Parcel "A" granted to the City of
Alameda;
NOW, THEREFORE, BF IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map
of Tract 3634, be, and hereby is approved.
BE IT FURTHER RESOLVED that the agreement for construction and completion of the public
improvements in said subdivision, and all its terms and conditions, be and hereby is approved,
and the City Manager and the City Clerk are authorized and directed to execute and attest to,
respectively, said agreement on behalf of the City of Alameda.
BE IT FURTHER RESOLVED that the Faithful Performance and Labor and Material Subdivision
Improvement Bonds, both in the total sum of 53.922,858, guaranteeing full and faithful performance
of the subdivider's said public improvements construction contract and the bond in the total sum
of $22,500, guaranteeing replacement of Turf-Blocks if use of said blocks should prove unsatisfactory
within five years, are hereby approved as sufficient in amount.
BE IT FURTHER RESOLVED that said easements and the parcel of land, designated "Street
Dedication," dedicated to the public are hereby accepted, on behalf of the public, for use in
conformity with the terms of the offers of dedication; and said access rights dedicated to the
City of Alameda, and said parcel of land granted to the City of Alameda, designated on said Final
Map as Parcel "A", are hereby accepted.
