Resolution 08709CITY OF ALAMEDA RESOLUTION NO. 8709
AUTHORIZING AGREEMENT WITH NIMLO RESPECTING NIMLO FEDERAL
UNEMPLOYMENT COMPENSATION TAX LITIGATION TRUST FUND
WHEREAS, the City of Alameda would be adversely affected by the U.S. Government
Unemployment Compensation Act of 1976; and
WHEREAS, the City of Alameda is a member of National Institute of Municipal Law
Officers (NIMLO); and
WHEREAS, at the NIMLO special meeting of April 3-5, 1977, the overwhelming view that
an attempt to collect a trust fund from member cities and from state and counties to attack the
constitutionality of the Unemployment Compensation Act of 1976 was expressed; and
WHEREAS, it was further agreed that said challenge be made only on behalf of those
who become parties to that litigation by contributing to said trust fund.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda agree to
contribute funds to the Trust Fund as more fully described in Exhibits A and B.
BE IT FURTHER RESOLVED that the Council directs the City Manager to execute on behalf
of the City, the agreement provided by NIMLO and attached as Exhibit 8, and all other documents
specified in Exhibit .4 and B.
