Resolution 08712CITY OF ALAMEDA RESOLUTION NO. 8712 CONSENTING, AS LEGISLATIVE BODY, TO THE DETACHMENT OF CERTAIN TERRITORY FROM THE CITY OF ALAMEDA AND CONSENTING TO ANNEXATION THEREOF TO THE CITY OF OAKLAND WHEREAS, the fee title to the territory hereinafter specifically described as Parcel One, lying within the City of Alameda, has been granted to the City of Oakland, a municipal corporation; and said territory is within the City of Alameda; and WHEREAS, the fee title to the territory hereinafter specifically described as Parcel Two, lying within the City of Alameda shall pass from the City of Alameda to the City of Oakland concurrently with the detachment by City of Alameda and annexation thereof to the City of Oakland as specified in the March 16, 1977 Annexation Agreement between the City of Alameda and the Port of Oakland; and WHEREAS, the City of Alameda desires to detach said territories and the City of Oakland to annex the same; NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda, as the legislative body of the City from which said territories are to be detached, consents by resolution to said detachment and annexation of those certain territories situated in the City of Alameda, County of Alameda, State of California, particularly described as follows: PARCEL ONE All that certain real property situated in the County of Alameda, State of California, being more particularly described as follows: All that portion of Lots 17, 18, 24, 25, 26, 27, 29, 30, 31, and 32 of Section 30 and Lots 1, 2, 3, 4, 5, 6, 7, 8, 14, 15, and 16 of Section 31, all in Township 2 South, Range 3 West, Mount Diable Base and Meridian and all that portion of Lots 15, ]7, 18, 19, 30, 31, and 32 of Section 25, T2S, R4W, MDB&M as said lots, sections, township and ranges are delineated and so designated on that certain map entitled, "Map No. 2 of Salt Marsh and Tidelands Situate in the County of Alameda, State of California, 1871," and delineated in the field notes thereof and certified copies thereof having been filed with the County Recorder of the City ard County of San Francisco and in the Office of the Department of Finance, Division of State Lands, State of California and being more particularly described as follows: Commencing at a granite monument which marks the common section corner of Settions 19 and 30 of T2S, R3W, and Sections 24 and 25 of T2S, R4W, MDB&M, said monument has the coordinates of y=454,723.06 feet and x=1,495,709.58 feet based on the California Coordinate System, Zone ITT, as are all bearings, distances and coordinates in this description; thence along a line which bears South 06°45'50" East 5,777.27 feet (beino a true bearing and distance of South 07°49'51" East 5,777.68 feet) to a point which has the coordinates of y=445,986.00 feet and x=1,496,390.01 feet, said point being on the northwestern boundary of that certain area annexed to the City of Oakland by Ordinance No. 4986 CMS, a map which was filed on August 17, 1956, in Map Book 40, at Page 57, Records of Alameda County, said point also being on the northwestern boundary of that certain area described in the Deed dated September 14, 1955 from the City of Alameda to the City of Oakland which was recorded September 23, 1955, in Book 7792 of Official Records, at Page 177, Records of Alameda County; thence along last said boundary North 41°03'21" East 206.94 feet to an angle point in the northern boundary of last said map (40M57), said Point also being on the southern boundary of the kreinabove referred to tideland lots, said point being the TRUE POINT OF BEGINNING; thence along the boundary common to tidelands lots and said annexation to the City of Oakland by Ordinance No. 4986 CMS South 68°37'15" East 4,661.08 feet to a point on the City boundary line as established by that certain annexation to the City of Oakland by Ordinance No. 455C CMS, a map of which was filed on August 9, 1955, in Map Book 32, at Page 94A, Records of Alameda County, last said boundary line being along the line common to Sections 31 and 32 of T2S, R3W, MDB&M; thence along last said section line and said City boundary line North 01°05'45" East 1,958.77 feet to the section corner common to Sections 29, 30, 31 and 32 of T2S, R3W, MDB&M, said corner being at an angle point in the City of Oakland boundary, as said boundary line was established by the annexation verified by the California Secretary of State on December 8, 1909 and was descriped in Resolution No, 35846, adopted December 8, 1909, by the City of Oakland; thence along said City boundary line being along the line common to Sections 29 and 30 of T2S, R3W,MDB&M North 01 0545" East 2,038.29 feet to a point at the most southeasterly corner of that certain parcel of land described as Parcel Two in the Agreement and Conveyance to the City of Alameda dated June 13, 1950, recorded October 3, 1950, Book 6245 of Official Records, at Page 293, Records of Ameda County, said point is distant thereon South 01°05'45" West 269.49 feet from the point designated as Monument No. 3 on that certain map entitled, "Coordinate Map of the Tidelands and Control Points in the Vicinity of Bay Farm Island Alameda County,' which was filed on April 19, 1956, in Map Book 40, at Page 30, Records of Alameda County; thence leaving last said City boundary along the hereinabove referred to southerly boundary line of Parcel Two (6245 OR 293) North 66°47'25" West 460.34 feet to the most easterly corner of the231.219 acre parcel of 350 land described in the Deed from the City of Oakland acting by and through its Board of Port Commissioners to Utah Construction and Mining Company which was recorded June 27, 1957, in Book 8402 of Official Records, at Page 61, Records of Alameda County; thence along the southeastern and southwestern boundaries of last said parcel South 40°19'40Nest 3,642.67 feet and North 38°5639" West 3,341.43 feet to a point on the range line between R3W, T2S, MDB&M, said point being at the corner common to the hereinabove referred to 231.219 acre parcel (84020961) and the 231.219 acre parcel of land described in the Final Order of Condemnation from Utah Construction Company to the City of Oakland, a municipal corporation, acting by and through its Board of Port Commissioners, a copy of which was filed on June 27, 1957, in Book 8402 of Official Records, at Page 55, Records of Alameda County; thence along the northeastern boundary of last said 231.219 acre parcel (8402 OR 55) North 40°2448" Nest, 1,605,97 feet; thence South 41°03'21" West 1,391.88 feet to a point on the southwesterly boundary of last said parcel, said boundary also being on the southerly boundary of the hereinabove referred to tideland lots of Map No, 2; thence along last said boundary South 48 2231 East 2,578.34 feet to the section corner common to Sections 30 and 31 of T2S, R3W and Sections 30 and 31 of T2S, R3W and Sections 25 and 36 of T2S, 848, MDB&M; thence South 68°3715' East 978.68 feet to the point of beginning. Containtg 269.51 acres, more or less, PARCEL TWO All that portion of the salt marsh tide and submerged lands, whether filled or unfilled, in the County of Alameda, State of California, which is a portion of the salt marsh, tide and submerged lands which were granted to the City of Alameda by an act of the Legislature of the State of California by the Statutes of 1913, Chapter 348, approved June 11, 1913, Chapter 348, approved June 11, 1913 and in effect August 10, 1913, which grant was amended by the Statutes of 1917, Chapter 594, approved May 24, 1917 and in effect July 27, 1917 and said area being referred to in Section 2 of the Statutes of 1955, Chapter 1028 which authorized the City of Alameda to convey certain parcels of such lands to the City of Oakland, and being more particularly described as follows: Being a portion of Sections 25 and 36 on Township 2 South, Range 4 West and Section 31 of Township 2 South, Range 3 West, Mount Diablo Base and Meridian which area is contiguous to and southerly cf the lots in said sections as said lots, sections township, and ranges are delineated and so designated on that certain map entitled, "Map No, 2 of Salt Marsh and Tidelands Situate in the County of Alameda, State of California, 1871," and delineated in the field notes thereof and certified copies thereof having been filed with the County Recorder of the City and County of San Francisco and in the office of the Department of Finance, Division of State Lands, State of California and being more particularly described as follows: Commencing at a granite monument which marks the section corner common to Sections 19 and 30 of T2S, 93W and Sections 24 and 25 of T2S, 94W, MDB&M, as said monument has the coordinates of y=454,723.06 feet and x=1,495,709.58 feet based an the California Coordinate System, Zone III, as are all bearings, distances and coordinates in this description; thence along a line which bears South 06°4550" East 5,777.27 feet (being a true bearing and distance of South 07°4951" East 5,777.68 feet) to a point whit; has the coordinates of y=448,986.00 feet and x=1,496,390.01 feet and is the TRUE POINT OF BEGINNING of the area being described; said point being on the north- western boundary of that certain area annexed to the City of Oakland by Ordinance No. 4986 CMS, a map which was filed on August 17, 1956, in Map Book 40, at Page 57, Records of Alameda County, said point also being on the northwestern boundary of that certain area described in the Deed dated September 14, 1955 from the City of Aalmeda to the City of Oakland which was recorded September 23, 1955, in Book 7792 of Official Records, at Page 177, Records of Alameda County; thence along last said northwestern boundary South 41'03'21" West 3,684,74 feet; thence North 5728'30" West 3,538.90 feet; thence North 41°03'21" East 4,112.71 feet to a point on the southwestern boundary line of the tideland lots in the hereinabove referred to Section 25 T2S, R4W, MDB&M, as said lots are delineated and so designated on the hereinabove referred to "Map No. 2 of Salt Marsh and Tidelands Situate in the County of 4:meda, State of California, 1871," said boundary also being the southwestern boundary of the 231.219 acre parcel of land described in the Final Order of Condemnation from Utah Construction Company to the City of Oakland, a municioal corporation, acting by and through its Board of Port Commissioners, a copy of which was filed on June 27, 1957, in Book 8402 of Official Records, at Page 55, Records of Alameda County; thence along last said boundary and along the boundary of said tideland lots South 48°22'31" East 2,578.34 feet to the section corner common to Sections 30 and 31 of T2S, R3W and Sections 25 and 36 of T2S, 940, MDB&M, thence South 68'37'15' East 978.68 feet to an angle point in the City of Oakland boundary established by Ordinance No, 4986 (40057); thence South 41°03'21" West 206.94 feet to the point of beginning, Containing 311.526 acres, more or less. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of May, 1977, by the following vote, to wit: AYES: Councilmen Beckam, Diament, Tillman and President Corica, (4).
