Resolution 08729369 CITY OF ALAMEDA RESOLUTION NO. 8729 FINDING AND DETERMINING THE CERTAIN PORTION OF COUNTY ROAD REFERRED TO IN RESOLUTION NO. 8710 IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES; FINDING NO RESERVATION OF EASEMENT THEREIN NECESSARY; ORDERING THE VACATION THEREOF, AND DIRECTING CITY CLERK TO CAUSE A CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED WHEREAS, the Council of the City of Alameda did, on May 3, 1977, pass its Resolution of Intention No. 8710, declaring its intention to order the vacation of a portion of a public street being 0.0873 acres more or less, situated in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: COMMENCING at the United States Coast and Geodetic Survey Monument "MAIT-CLUB", having coordinates Y=455,687.22 feet and X=1,497,730.40 feet based on the California Coordinate System, Zone III, as are all bearings and distances in this description: THENCE S. 87°3606" W. 86.36 feet to a point on the westerly line of Maitland Drive, as said Drive is shown on that certain map entitled "PROPERTY OF UTAH CONSTRUCTION COMPANY, BAY FARM ISLAND IN THE CITY OF ALAMEDA, ALAMEDA COUNTY, CALIFORNIA", filed August 13, 1956, in Book 40 of Maps at Pages 53 to 56, inclusive, County of Alameda Records: THENCE S. 11°2332" W. along said westerly line 848.00 feet to an angle point; THENCE contining along said westerly line S. 00°43'32" W. 44.19 feet to the TRUE POINT OF BEGINNING, having coordinates Y=454,806.62 feet and X=1,497,476.13 feet; THENCE S. 55°5633'2 E. 9.56 feet; THENCE southerly on a tangent curve concave southwesterly, having a radius of 20.00 feet, through a central angle of 56°4005, for an arc distance of 19.78 feet; THENCE S. 00°4332" W. 138.89 feet; THENCE southerly on a tangent curve concave easterly, having a radius of 95.00 feet, through a central angle of 24°3340", for an arc distance of 40.72 feet to a point cf reverse curvature; THENCE southerly along a curve concave westerly, the center of which bears S. 66°9052" W. from said last named point, having a radius of 20.00 feet, through a central angle of 77°5056", for an arc distance of 27.17 feet to a point on said westerly line of Maitland Drive; THENCE along said westerly line N. 39'1628" W. 30.11 feet and N. 00°4332' E. 201.62 feet to the TRUE POINT OF BEGINNING, containing 0.0873 acres, more cr less., and in said Resolution found and determined that public convenience and necessity do not require reservation by that said City of any easements or rights of way in said portion of said street; and WHEREAS, particulars of the proposed vacation are shown on that certain map entitled, "Portion of County Road Abandonment Mecartney Road to Island Drive," on file in the office of the City Clerk and being City Engineer's Drawing No. 73798, Case 51; and WHEREAS, the City Clerk of the City cf Alameda caused said Resolution of Intention to be published and notice thereof and of the time and place of hearing thereon was duly posted in accordance with the requirements of Part 3 of Division 9, of the Streets and Highways Code of California; and WHEREAS, prof of said publication is evidenced by an affidavit of publication now on file in the office of the City Clerk of said City; and WHEREAS, proof of said posting of such notices is evidenced by the affidavit of the persons posting said notices; and is now on file in the office of the City olerk of said City; and WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council of the City of Alameda at this, its regular meeting, on the 7th day of June, 1977, and at the time and place fixed in said Resolution of Intention, and persons interested in said street vacation; and a full hearing thereon having been had and the matter submitted for determination; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street in said Resolution of Intention and hereinbefore more particularly described is unnecessary for present and prospec- tive public street purposes and that public interest requires the vacation of said street. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have a certified copy of this Resolution recorded in the office of the Recorder of Alameda County, California. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled or the 7th day of June, 1977, by the following vote, to wit: AYES: Councilmen Beckam, Sherratt, Tillman and Vice President Diament, (4).
