Resolution 08837CITY OF ALAMEDA RESOLUTION NO. 8837 APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3903, AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, APPROVING BOND AS TO SUFFICIENCY, AND ACCEPTING CERTAIN PUBLIC STREETS, EASEMENTS AND ACCESS RIGHTS (HARBOR BAY ISLE ASSOCIATES, SUBDIVIDER) WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, there has heretofore been filed with and approved by the Council a Tentative Map of that certain proposed subdivision known as Tract 3645; and WHEREAS, Harbor Bay Isle Associates, a partnership comprised of Doric Development, Inc., a California corporation ,and Bay Farm Island, Inc., a Nevada corporation, subdivider herein, has presented to the Council for approval a Final Map of that proposed subdivision known as Tract 3903 which consists of Block 14 of said Tract 3645; and WHEREAS, said subdivider has entered into an agreement with the City of Alameda to construct and complete the public improvements in said subdivision and to post with the City Clerk of the City of Alameda a bond to guarantee full and faithful performance of said work, all in accordance with said Article; and WHEREAS, said Final Map delineates thereon certain easements designated "Public Utilities Easement," "Storm Drain Easement," "Sanitary Sewer Easement" and "Power Easement," and parcels of land known as Dike Road, Bayfarer Way, Footbridge Lane, Pirates Lane and Basinside Way, dedicated to the public; and access rights over all of certain parcels designated "A" and "B" for the purposes of lagoon maintenance and operations of public safety vehicles and emergency equipment, dedicated to the City of Alameda; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3903 be and hereby is approved. BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to, respectively, said agreement on behalf of the City of Alameda. BE IT FURTHER RESOLVED that the bond in the total sum of $899,757.00, guaranteeing full and faithful performance of the subdivider's said public improvements construction contract, is hereby approved as sufficient in amount. BE IT FURTHER RESOLVED that said easements and parcels of land dedicated to the public are hereby accepted, on behalf of the public, for use in conformity with the terms of the offers of dedication, and said access rights dedicated to the City of Alameda are hereby accepted. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 20th day of December, 1977, by the following vote, to wit: AYES: Councilmen Beckam, Didment, Sherratt, Tillman and President Corica, (5).
