APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT
3922, AUTHORIZING EXECUTION OF AGREEMENT FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS, THEREIN,
APPROVING BOND AS TO SUFFICIENCY, AND ACCEPTING A
PUBLIC UTILITIES EASEMENT DEDICATED TO THE PUBLIC
(CALIFORNIA- NEVADA METHODIST HOMES, OWNER, AND
PAUL SCHMIDT, SUBDIVIDER AND DEVELOPER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the
Alameda Municipal Code, there has heretofore been filed with and
approved by the Council a Tentative Map of that certain proposed
subdivision known as Tract 3922; and
WHEREAS, California-Nevada Methodist Homes, a California
non-profit corporation, owner thereof, and Paul Schmidt, subdivider
herein, have presented to the Council for approval a Final Map of
that proposed subdivision known as Tract 3922; and
WHEREAS, said subdivider has entered into an agreement
with the City of Alameda to construct and complete the public
improvements in said subdivision and to post with the City Clerk
of the City of Alameda a bond to guarantee full and faithful
performance of said work, all in accordance with said Article; and
WHEREAS, said Final Map delineates thereon an easement for
public utilities and their appurtenances designated "Public
Utilities Easement" and dedicated to the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Final Map of Tract 3922 be and hereby is
approved.
BE IT FURTHER RESOLVED that the agreement for construction
and completion of the public improvements in said subdivision,
and all its terms and conditions, be and hereby is approved, and
the City Manager and the City Clerk are authorized and directed
to execute and attest to, respectively, said agreement on behalf
of the City of Alameda.
BE IT FURTHER RESOLVED that the bond in the total sum of
$35,000.00, guaranteeing full and faithful performance of the
subdivider's said public improvements construction contract, is
hereby approved as sufficient in amount.
BE IT FURTHER RESOLVED that the easement designated "Public
Utilities Easement" and dedicated to the public is hereby accepted,
on behalf of the public, for use in conformity with the terms of
the offer of dedication.
1, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 4th day of April,
1978, by the following vote, to wit:
AYES: ,Councilmen Beckam, Diament, Sherratt, Tillman,
and President Corica, (5).
NOES: None.
ABSENT: None.
