ORDERING VACATION OF UNUSED STORM DRAIN EASEMENT
(10 -FOOT EASEMENT WITHIN TRACT NO 3645)
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that
the certain storm drain easement within subdivision Tract 3645,
accepted by the City on August 2, 1977 by Resolution No 8767,
being situated in the City of Alameda, County of Alameda, State of
California, and more particularly described as:
A strip of land 10.00 feet in uniform width
designated as "10'S.D.E. ",on that certain map
entitled, "TRACT 3645, ALAMEDA, CALIFORNIA" filed
August 9, 1977, in Book 96 of Maps at pages 33 thru
39, inclusive, County of Alameda Records, said
strip being in the northerly portions of Block 15
and Parcel "G" of said Map and having a centerline
course of N.69 °38'35 "W. 117.64 feet from the
southerly line of Bridgeway Road as shown on said
map to the westerly line of said Block 15.,
is hereby ordered vacated pursuant to the provisions of Section
50443, Government Code. of Californ
BE IT FURTiR RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the said easement
ordered vacated herein is unnecessary for present or prospective
public use, and (2) that said easement has never been used by the
City of Alameda for any purpose whatever since August 2, 1977,
the date of its acceptance by the City, to the date of this
resolution.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 15th day of August,
1978, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Sherratt, Tillman, and
President Corica, (5).
