CITY OF ALAMEDA RESOLUTION NO. 8997
APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 4025
AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF
PUBLIC IMPROVEMENTS THEREIN, APPROVING BOND AS TO
SUFFICIENCY, AND ACCEPTING CERTAIN EASEMENTS AND
ACCESS RIGHTS (GREAT AMERICAN HOMES, ALAMEDA, SUBDIVIDER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the
Alameda Municipal Code, there has heretofore been filed with and
approved by the Council a Tentative Map of that certain proposed
subdivision known as Tract 3810; and
WHEREAS, Great American Homes, Alameda, a joint venture
composed of The Great American Land and Development Company, Inc.,
a California corporation and Larry C. Y. Lee, Clarence Yee, Bruce
Sanford, as individuals and as general partners of Alameda Isle
Development, a limited partnership, subdivider herein, has presented
to the Council for approval a Final Map of that proposed subdivision
known as Tract4025 which consists of a portion of amended Tract
3810 filed in Book 106 of Maps at Page 15, Alameda County Records;
and
WHEREAS, said subdivider has entered into an agreement with
the City of Alameda to construct and complete the public improve-
ments in said subdivision and to post with the City Clerk of the
City of Alameda a bond to guarantee full and faithful performance
of said work, all in accordance with said Article; and
WHEREAS, said Final Map delineates thereon public utility
easements and the right to construct, maintain, and replace such
utilities, facilities, and their appurtenances upon, over and under
Lots 65, 66 and 67 and designated as "Common Area Lots," granted
to all servicing public utility companies; and rights of access
over all of said Lots 65, 66 and 67, inclusive, for the purposes of
lagoon maintenance and operations of public safety vehicles and
emergency equipment, dedicated to the City of Alameda;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Final Map of Tract 4025 be, and hereby is
approved.
BE IT FURTHER RESOLVED that the agreement for construction
and completion of the public improvements in said subdivision,
and all its terms and conditions, be and hereby is approved, and
the City Manager and the City Clerk are authorized and directed
to execute and attest to respectively, said agreement on behalf
of the City of Alameda.
BE IT FURTHER RESOLVED that the bond in the total sum of
$747,380.00, guaranteeing full and faithful performance of the
subdivider's said public improvements construct on contract, is
hereby approved as sufficient in amount.
BE IT FURTHER RESOLVED that said easements granted to all
servicing public utility companies are hereby accepted, on behalf
of the public, and said access rights dedicated to the City of
Alameda are hereby accepted.
I, the undersigned, hereby certify that the foregoing Resolution
was doly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 7th day of November,
1978, by the following vote, to wit:
AYES: Councilmen Diament, Tillman, and President Corica, (3).
NOES: None.
ABSENT: Councilmen Beckam and Sherratt, (2).
