REQUESTING STATE LEGISLATURE TAKE STEPS TO PROHIBIT
SALE OF DRUG PARAPHERNALIA
WHEREAS, the California Health and Safety Code prohibits
the possession of (drug) paraphernalia; and
WHEREAS, the enforcement and interpretation of said
paraphernalia law requires proof that paraphernalia has been or
will be used for illegal drug use and
WHEREAS, such interpretation permits the selling of
paraphernalia in, for example, record stores; and
WHEREAS, these stores are often near shcools;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that said Council requests the State Legislature take
steps necessary to prohibit the sale of paraphernalia.
BE IT FURTHER RESOLVED that copies of this resolution be
forwarded to state legislators representing the City of Alameda
as well as to the League of California Cities.
