Resolution 09045CITY OF ALAMEDA RESOLUTION NO. 9045 APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3841, AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, APPROVING BONDS AS TO SUFFICIENCY, AND ACCEPTING CERTAIN PUBLIC STREETS AND EASEMENTS (SANDPIPER COVE ASSOCIATES, SUBDIVIDER) WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, there has heretofore been filed with and approved by the Council a Tentative Map of that certain proposed subdivision known as Tract 3810; and WHEREAS, Sandpiper Cove Associates, a joint venture of Warmington Development, Inc., a California corporation, and Hermes Financial Corporation, a California corporation, subdivider herein, has presented to the Council for approval a Final Map of that proposed subdivision known as Tract 3841 which is a resubdivision of Lots 3, 4, 5 and 18 of Block 3, Tract 3810; and WHEREAS said subdivider has entered into an agreement with the City of Alameda to construct and complete the public improve- ments in said subdivision and to post with the City Clerk of the City of Alameda bonds to guarantee full and faithful performance of said work, all in accordance with said Article; and WHEREAS, said Final Map delineates thereon certain easements designated "Public Utilities Easement," "Storm Drain Easement," and "Power Easement," and parcels of land known as Puddingstone Road, Sheffield Road, Harbor Bay Parkway, Kevington Place, Brighton Road, Brighton Court, Ennismore Lane, Ennismore Court, Cheswick Lane, Inverness Way, Berkshire Road, Roxburg Lane, Weymouth Court, Norwich Road, Hampton Lane, Hampton Court and Avington Road, dedicated to the public; and 1.00-foot strips of land designated as Parcels 1 and 2 inclusive, granted to the City of Alameda; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3841 be, and hereby is, approved. BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to, respectively, said agreement on behalf of the City of Alameda. BE IT FURTHER RESOLVED that the bonds in the sums of $3,160,000.00, guaranteeing full and faithful performance of the aubdivider's said public improvements construction contract, are hereby approved as sufficient in amount. BE IT FURTHER RESOLVED that said easements and parcels of land dedicated to the public are hereby accepted, on behalf of the public, for use in conformity with the terms of the offers of dedication, and said Parcels 1 and 2, inclusive, granted to the City of Alameda, are hereby accepted. *Instrument of Credit has been accepted in lieu of bond. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 6th day of February, 1979, by the following vote, to wit: AYES: Councilmen Beckam, Diament, Sherratt, Tillman, and President Corica, (5).
