AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION
AND COMPLETION OF IMPROVEMENTS IN CONNECTION WITH
PARCEL MAP NO 2865 AND APPROVING FAITHFUL PERFORMANCE
BOND AS TO SUFFICIENCY (1402 SHERMAN STREET -
EMILY D. SILVA AND ELIZABETH M. WHITE, SUBDIVIDERS)
WHEREAS, pursuant to Section 11-319.1 of the Alameda
Municipal Code, there has been presented to this Council a Parcel
Map, designated Parcel Map No. 2865, and heretofoxe conditionally
approved by the Planning Board, being a subdivision of Lots 38,
39 and 40, Block 20, Map known as the Homestead of Mary A. Fitch,
filed April 21, 1874, Map Book 19, Page 1, Alameda County Records,
known as 1402 Sherman Street in Inc City of Alameda, by Emily D.
Silva and Elizabeth M. White; and
WHEREAS, said approval by the Planning Board is conditioned
upon the subdividers constructing and completing certain public
improvements on said property; and
WHEREAS, said subdividers have entered into an agreement
and have posted their bond guaranteeing full and faithful
performance of said work, all in accordance with said section; and
WHEREAS, it will be to the benefit of the City to have said
work performed in accordance therewith;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the agreement for the construction and completion
of the improvements in the subdivision of property at 1402 Sherman
Street, designated as Parcel Map No. 2865, by Emily D. Silva and
Elizabeth M. White, be and the same hereby is approved and the
City Manager is authorized and directed to execute, and the City
Clerk Lo attest, said agreement on behalf of the City; and
BE IT FURTHER RESOLVED that the bond in the sum of
15,100.00, guaranteeing full and faithful performance of said
agreement, is hereby approved as sufficient in amount.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted by the
Council of the City of Alameda in regular meeting assembled on the
6th day of February, 1979, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Sherratt, Tillman,
and President Corica, (5).
NOES: None.
ABSENT: None.
