Resolution 09059CITY OF ALAMLDA RESOLUTION NOD 9059 DECLARING CANVASS OF RETURNS AND RESULT OF GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH SPECIAL MUNICIPAL CHARTER AMENDMENT ELECT AND SPECIAL ADVISORY MEASURE ELECTION HELD ON MARCH 6, 1979 WHEREAS, a General Municipal Election consolidated with a Special Municipal Charter Amendment Election and Special Advisory Measure Election was held in the City of Alameda on Tuesday, March 6 1979, under and pursuant to the provisions of title XIX of the Charter of said; City, for the purpose of 'electing officers to the .ices of Mayor, Councilman, Member of the Board of Education, and Treasurer, and for the further purpose of submitting to tiie qualified electors of said City amendments to the Charter of the City of Alameda and an Advisory Measure, as set forth hereinafter: One (1) Mayor of said City fora full term commencing at 8:00 o'clock p.m. on the third Tuesday in April, 1979, and continuing for four (4) year thereafter and until a successor is elected and qualified; Two (2) Counci men on the Council of said City for two full terms, each term commencing at 8:00 o'clock p.m. on the third Tuesday in April, 1979, and continuing for four (4) years thereafter and until a successor is elected and qualified One (1) Treasurer o aid City for one two -year term commencing at 8:00 o °clock P. on the' third Tuesday in April, 1979, -and continuing for tyro (2) years thereafter and until a successor is elected and qualified; Two (2) members of the Board of Education of said City, each term commencing at 8 :00 o'clock p.m. on the third Tuesday in April, 1979, and continuing for four'(4) years thereafter and until a successor is elected and qualif ed. MEASURE A Shall the Charter of the, City: of Alameda be amended to delete that section which forbids any person convicted of a felony from ever holding an office or position with the City? Said` amendment accomplished by amending Section 22 -4 of Article XXII, all as fully set forth in Resolution No 9030 of the Council of the City of Alameda. MEASURE B Shall the Charter of the City of Alameda be amended to provide that certain appointed officers, except within a certain time after installation of a new Council Member, and members of Charter Boards may be removed by a simple majority vote of the Council? Said - amend- ment will be accomplished by amending Section 2 -2 of Article' II and Section 10 - -9 of Article X, all as fully set forth in Resolution No. 9030 of the Council of the City of Alameda. MEASURE C Shall the Charter of the City o Alameda be- amended to provide for the abolition of the elective offices of Auditor and Treasurer and estab- lishment of the office of City Finance Officer to be appointed by the City Council, said off, deer to perform the duties designated in said Charter and by ordinance for those offices to be abolished, to become effective in 1981? Said amendment will be accomplished by amending Sections 2 -1 and 2 -2 of and adding Section 2-1,1 to Article II, by amending Section 4-1 and repealing Sections 4-2, 4-3, 4 -4, 4 -5 and 4-6 of Article IV and repealing Article V in its entirety, all as fully set forth in Resolution No. 9030 of the Council of the City of Alameda. MEASURE D Shall the Charter of the City of Alameda be amended to establish a City Council consisting of seven members, comprised of a Mayor, Council Member - at-Large and five Council Members, nominated from districts to be established by ordinance, and elected at large? Said amendment will be accomplished by amending Sections 2 -1, 2 -2, 2 -6.1 and adding Sections 2 -6.2, 2 -6.3', 2 -6.4 and 2 -6.5 to Article II; amending Sections 3 -1, 3 -1.1, 3 -4, 3 -7(B), 3 -7(I), 3 -10 and 3 -12 of and adding Section 3 -1.2 to Article III, amending Section 13 -2 of Article XIII; and amending Section 17 -5 of Article XVII all as fully set forth in Resolution' No. 9030 of the Council of the City of Alameda. MEASURE E Shall the Charter of the City of Alameda be amended to permit the City Council to adopt ordinances at special meetings? Said amendment will be accomplished by amending Section 3 -11 of Article I11, all as fully set forth in Resolution No. 9030 of the Council of the City of Alameda. MEASURE F Shall the Charter of the City of Alameda be amended to permit the City Council to determine by ordinance the form of organization of the City Planning Board and the number of members thereon? Said amendment will be accomplished by amending Section 10 -4.1 of Article X, all as fully set forth in Resolution No. 9030 of the Council of the City of Alameda. MEASURE G Shall the Charter of the City of Alameda be amended to provide that all persons be residents of the City for thirty days before filing of nomination papers for any elected office? Said amendment will be accom- plished by amending Section 2-5 of Article II, all as set forth in Resolution No. 9030 of the Council of the City of Alameda. ADVISORY' MEASURE H Shall the City of Alameda use Housing and Community Development Act - monies to facilitate the private development of dwelling: units, some of which may be used to provide living accommodations for low and moderate income persons, which may include the - handicapped and elderly, provided that: (1) No more than 49% of said dwelling units may be used for subsidized housing for persons of low and moderate construction of said dwelling units wi property shown on the Alameda County Asse 74- 433 -9, 74- 432 -14 and 74- 436 -26, more c ncome; (2) The only site for the be those certain pieces of real 's Map as Parcels 74- 434 -1, nly recognized as the property bordered by Atlantic and Buena Vista Avenues westerly of Webster Street; (3) In any case, no more than 50 units shall be used as subsidized housing; and (4) The property remains on the tax rolls. Hyde ASURER: WHEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the t e, form and manner prescribed by law, whereupon a notice of Nominees for Public Office containing a statement of the time of the election, the offices to be filled, and the names of the candidates to be voted on, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said City; the last publication thereof being more than five (5) days before the, date of said election, and WHEREAS, a Notice of the Proposed Amendments to the Charter of the City of Alameda, and a notice of the Advisory Measure, both certified by the City Clerk, were duly issued and published in the official newspaper of said City in the manner and ti by law; and WHEREAS, there were 47 consolidated election precincts within the City of Alameda fixed and designated by resolution of the Council of said City and designated, fixed and established by the Board of Supervisors of the County of Alameda, State of California, as the consolidated election precincts within the City of Alameda for holding general state and county elections, as the consolidated election precincts for holding the aforesaid General Municipal Election consolidated with Special Municipal Charter Amendment Election and Special Advisory Measure Election of the City of Alameda; and WHEREAS, and contents, as p City of Alameda wi completed at least esc hin ten r;the hallots used for said election were prepared, as to form bed by las!a, and a sample ballot was mailed to each voter of the he time and in the manner provided by law and such mailing was 10) whole days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by Taw; and WHEREAS, the Council of the City of Alameda, at this, the first Tuesday following said election, has met and fully canvassed the returns of the votes cast at said General Municipal Election consolidated with Special Municipal Charter Amendment Election and Special Advisory Measure Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as follows: (1) That said General Municipal Election consolidated with Special Muni- cipal Charter Amendment Election and Special Advisory Measure Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law, (2) That the number of votes given at each precinct to each of the afore - said candidates and measures was, as shown in the Result of Votes Cast, on file in the office of the City Clerk, copy of which is attached hereto. "Chuck" Corica, having received the highest number of votes cast for the office of Mayor, was, and is hereby declared to be, duly and regularly elected to the office of Mayor of the City of Alameda for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1979, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Richard H. "Rich" Sherratt and Amey Stone, having received the two highest numbers of votes cast for the office of Councilman, were, and are hereby declared to be, duly and regularly elected to the office of Councilman of the City of Alameda each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1979, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Donal D. "Casey" Cummins and Barbara M. Borden, having received the two highest numbers of votes cast for the office, of Member of the Board of Education, were, and are hereby declared to be, duly and regularly elected to the office of Member of the Board of Education of the City of Alameda, each for a term beginning at 8 :00 o'clock p,rn., on the third Tuesday in April, 1979, and continuing for four (4) years thereafter and until a successor is elected and qualified BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Florence B.
