Resolution 09099CITY OF ALAMEDA RESOLUTION NO. 9099 APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3842; AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, APPROVING BONDS AS TO SUFFICIENCY, AND ACCEPTING CERTAIN EASEMENTS AND ACCESS RIGHTS (HARBOR BAY ISLE ASSOCIATES, SUBDIVIDER) WHEREAS, pursuant to Article 1, Chapter 3, Title Alameda Municipal Code, there has heretofore been filed approved by the Council a Tentative Map of that certain subdivision known as Tract 3842, being a subdivision of and 17, Block 3, Tract 3810, filed June 9, 1978 in Book Maps, Pages 43 through 57, Alameda County Records; and XI of the with and proposed Lots 16 103 of WHEREAS, Harbor Bay Isle Associates, a partnership comprised of Doric Development, Inc., a California corporation and Bay Farm Island, Inc., a Nevada corporation, subdivider herein, has presented to the Council for approval a Final Map of that proposed subdivision known as Tract 3842; and WHEREAS, said subdivider has entered into an agreement with the City of Alameda to construct and complete the public improve- ments in said subdivision and to post with the City Clerk of the City of Alameda a bond to guarantee the future improvement of Harbor Bay Parkway, a bond to guarantee the interlocking paving stones in parking areas and crosswalks, and a bond to guarantee full and faithful performance of the remainder of said work, all in accordance with said Article; and WHEREAS, said Final Map delineates thereon certain ease- ments designated "Public Utilities Easement, "Storm Drain Easement" and "" Power Easement," dedicated to the public, and right of access over Lot 48 for operations of public safety vehicles and! emergency equipment dedicated to the City of Alameda; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3842 be, and hereby is approved. BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to respectively, said agreement on behalf of the City of Alameda. BE IT $201,000 gua: Parkway, the interlocking the bond in 1 faithful per construction amount. FURTHER RESOLVED that the bond in the total sum of antecing the future improvement of Harbor Bay bond in the total sum of $21,000 guaranteeing the paving, stones in parking areas and crosswalks, and he total sum of $458,000 guaranteeing full and ormance of the subdivider °s said public improvements contract, are hereby approved as sufficient in BE IT FURTHER RESOLVED that said easements designated "Public Utilities Easement," "Storm Drain Easement" and "Power Easement," dedicated to the public are hereby accepted, on behalf of the public, for use in conformity with the terms of the offers of dedication, and said access rights dedicated to the City of Alameda are hereby accepted. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adoated by the Council of the City of Alameda in regular meeting assembled on the 19th day of June, ,1979, by the following vote, to wit: AYES: Councilmen Diament, Sherratt, Stone, Tillman, and President Corica,';(5).'
