Resolution 09150CITY OF ALAMEDA RESOLUTION NO. 9150 ADOPTING MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF ALAMEDA AND THE ALAMEDA MUNICIPAL MANAGEMENT AND CONFIDENTIAL EMPLOYEES ASSOCIATION BE IT RESOLVED BY THE COUNCIL OF TEE CITY OF ALAMEDA that the attached Memorandum of Understanding agreed to between \ the City's representatives and the Alameda Municipal Management LIA,A ' and Confidential Employees Association is hereby adopted, to be Olee effective July 1, 1979. • * * * * * * \ MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding entered into between the City of Alameda, hereinafter called the "City," and the Alameda Municipal Management and Confidential Employees Association hereinafter called the "Association," represents the results of meeting and conferring in good faith in accordance with Section 3505 of the California Government Code, and covers those areas of mutual agreement for the period of July 1, 1979 through June 30, 1980. The parties executing this Memorandum are the duly appointed representatives of the Association and the Municipal Employee Relations Officer of The City of Alameda. The adjustments to wages, hours and conditions of employment set forth in this Memorandum have been discussed in good faith between the parties hereto. The representatives of the Association agree to its acceptance by its members of all adjustments set forth herein, and along with the Municipal Employee Relations Officer, agree to recommend to the City Council that all adjustments set forth herein be adopted in full by the City Council in the manner and under the procedure prescribed by law. It is understood by the parties that the adjustments set forth herein represent only recommended changes in existing policies and procedures as stated in various ordinances, resolutions and memoranda, and are not represented as a complete and comprehensive statement of these policies and procedures. It is also understood that any adjustments which by law require action by the City Council shall become effective and in force only if the Council takes such action by its affirmative vote. The recommendations of the parties to this Memorandum of Understanding include: 1. Dental Care Effective July 1, 1979, the City shall contribute Twenty-two Dollars and Forty-one Cents ($22.41) per month per eligible employee toward the City's dental plan. 2. Kaiser Health Insurance Plan Effective July 1, 1979, the City shall make the following contributions per month per eligible employee toward the Kaiser Health Insurance Plan: Employee $ 30.90 Employee and one dependent $ 61.80 Employee and two or more dependents $ 89.28 Effective November 1, 1979, the contribution shall be increasod to the fol 1 wing rate: Employee Employee and one dependent Employee and two or more dependents 3. Blue Cross Insurance Plan $ 31.91 $ 63.82 $ 92.17 Effective July 1, 1979, the City shall make the fol lowinq contribution per month per eligible employee toward the Blue Cross Health Insurance Plan: Employee $ 44.03 Employee and one dependent $105.95 Employee and two or more dependents $131.32 4. Insurance The City shall pay the full premium for term life, accidental death and dis- memberment insurance for employees represented by the Association with coverage provided per employee of $15,000.00. 5. Sick Leave Stud,/ At the request of the City the Association will undertake a study of the whole sick leave program. 6. Layoffs If the City decides to lay off any employee or discontinue any position represented by the Association , the Association shall receive notice concurrently with the affected employee. 7. Private Vehicle Use Reimbursement The City shall reimburse employees represented by the Association for authorized use of personal automobiles on City business at the rate of Seventeen Cents (17() per mile effective July 1, 1979. 8. Classifications The City shall undertake within the 1979-1980 fiscal year, if resources are available, a comprehensive study of certain classifications of confidential employees and those below department heads represented by the Association. Such study shall include an analysis of responsibilities and a comparison of compensation levels in positions within the City, in other reasonably compar- able cities, and, where applicable, in private sector employment in the region. 9. Safety Forces ClassifiCations in the Police and Fire Departments represented by the Association shall continue to receive benefits under the Educational Training Incentive Program, uniform allowance and holiday pay provided by the City to safety forces employees. 10. Funeral Leave In the event of a death in the immediate family of an employee who has one (1) or more years of uninterrupted service with the City, the employee shall, upon request, be granted such time off with pay as is necessary to make arrangements for the funeral and attend same, not to exceed three (3) regularly scheduled working days. This provision does not apply if the death occurs during the employee's paid vacation, or while the employee is on leave of absence, layoff, or sick leave. For the purposes of this provision, the immediate family shall be restricted to father, mother, brother, sister, spouse, child, mother-in-law, father-in-law, grandparents and grandchildren. At the request of the City, the employee will furnish a death certificate and proof of relationship. Funeral leave applies only in instances in which the employee attends the funeral or is required to make funeral arrangements, but is not applicable for other purposes such as settling the estate of the deceased. 11. Illness in the Immediate Family An employee may use up to twenty (20) hours of accrued sick leave in any twleve (12) consecutive month period for illness in the immediate family. For the pur- pose of this provision, immediate family means spouse, child or dependent living within the employee's household. At the City's request the employee will provide satisfactory evidence of the facts justifying such absence. 12. -Floating Holiday in Lieu of Columbus Day Effective july 1, 1979 a floating holiday shall be substituted for Columbus Day. The date on which the floating holiday may be celebrated by the employee shall be by mutual agreement between the employee and his or her Department Head or designated representative. 13. Expenses Reimbursement for Conferences and Professional Development The City acknowledges that it is of value to the City for members of the Association" to keep up with developments in areas of Their responsibility. The City shall review the tentative allocations made in the 1979-1980 budget for conferences, memberships in professional societies, and educational reimbursement for professional development of members of the "Association" in areas of their responsibility. -2- 14. Recognition of Extraordinary Time Requirements on Management Employees a. As partial, recognition of the special responsibilities undertaken by manage- ment employees, those management employees represented by The Association who are required to put in time on-the-job beyond a normal m^nagomen| work week shall be credited with up to five working days during a fiscal year as "admini- strative leave" in lieu of overtime. This administrative leave time will not be accumulative from one year to 1bc next. At the option of the management employee, administrative leave time may be exchanged at the end of the fiscal year for direct payment calculated at straight time at the employee's salaried rate. Administrative leave shall be approved by the City Manager after an annual review of the management employee's extraordinary time requirements. b. Without regard to the above provisions for administrative leave, the City Manager may, at the request of the department head, authorize "special leave" time off to management personnel for required work in unusual or emergency situations, not to exceed five working days during the fiscal year. In addition, /nformo| short periods of time may be authorized as informal compensatory time off, for periods of less than a working day. �15. Salaries The salaries for the classifications represented by the Association are set forth in Appendix A. 16. Health 8, Welfare Study The City intends to evaluate the hospital-medical, life insurance, and dental plans which are currently available to employees. In the event that it may be possible to provide hospital-medical, life insurance and dental coverage as nearly comparable as possible to the benefits in effect on July 1, 1979' without additional cost to the City or tbe employees, the City may substitute new insurance carriers. The Association will be given an opportunity to review the coverage afforded under such substitute plans before they are implemented. 17. Term of Agreement This Memorandum of Understanding shall be effective upon ratification by the Association and approval by the Alameda City Council for the period July 1, 1979 through June 30, leun' but in no event shall it become effective on a date earlier than July 1, 1979. This Memorandum of Understanding is subject to all existing State laws and the City Charter, ordinances, resolutions and administrative rules of the City except as expressly provided to the contrary by this Memorandum of Understanding. The City of Alameda agrees to continue with any and all fringe benefits sLich as holidays, vaca+iuns, sick |eavo and retirement.
