ORDERING VACATION OF UNUSED PATHWAY EASEMENT
AND PORTION OF UNUSED PUBLIC UTILITIES EASEMENT
IN LOT 2 OF SUBDIVISION TRACT 3773
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that
a certain pathway easement and a portion of a public utilities
easement within Lot 2 of Subdivision Tract 3773, accepted by the
City on July 18, 1978, and recorded in the County Recorder's
Office on July 24, 1978 in Book 104 of Maps, Pages 18, 19 and 20,
County of Alameda Records, and described as:
PARCEL 1 - Pathway Easement
All that certain "Pathway Easement", being a
parcel of land designated, "15' P.U.E. and Pathway
Easement", in the Northerly 15 feet of Lot 2 of
said Tract 3773,
PARCEL 2 - Portion of Public Utilities Easement
All of the easterly portion of that certain
parcel of land designated, "15 P.U.E. & Pathway
Easement", said Easement being in the northerly
fifteen feet of Lot 2 of said Tract 3773, said
portion lying between the southerly prolongation
of the East line of the "10' Sanitary Sewer Easement"
in the easterly portion of Lot 1 of said Tract 3773,
and the West line of Seal Point Court as shown on
said map of Tract 3773.,
are hereby ordered vacated pursuant to the provisions of Section
50443, Government Code of California.
BE IT FURTHER RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the said easements
ordered vacated herein are unnecessary for present or prospective
public use, and (2) that said easements have never been used by
'4 the City of Alameda for any purpose whatever since July 18, 1978,
the date of their acceptance by the City, to the date of this
resolution.

I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the City
of Alameda in regular meeting assembled on the 15th day of January, 1980,
by the following vote, to wit:
AYES: Councilmen Diament, Sherratt, Stone,
Tillman, and President Corica, (5)
NOES: None
ABSENT: None
