AMENDING CITY OF ALAMEDA GUIDELINES FOR THE
IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT OF 1970
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA
that the "State EIR Guidelines" for the implementation of the
California Environmental Quality Act of 1970, adopted by
reference by the City of Alameda, with amendments, additions
and deletions thereto, on April 5, 1977, by Resolution No. 8696,
is hereby amended by deleting Section 15161(h), by amending the
first sentence of Section 15161(d) and by amending Section
15083(e) thereof, to read as follows:
"Sec. 15161. Review of Environmental Impact Reports:
(d) If, after reviewing the Initial Study, the
Planning Board determines that the project will not
have a significant effect on the environment, a pro-
posed Negative Declaration shall be prepared for
review pursuant to Section 15083(e).
"Sec. 15083, Negative Declaration.
(e) Public Review.
(1) The proposed Negative Declaration shall
be made available by the Planning Department, to the
public for comment for a period of thirty (30) days,
unless a longer period is specified by the Planning
Board. Staff shall prepare responses to comments within
the time limits set by Sec. 15054.2. The Planning Board
may adopt a Negative Declaration after reviewing the
comments and responses.
(2) The adoption of a Negative Declaration
is appealable to the City Council by filing with the
City Clerk a notice of appeal within ten (10) days of
said adoption.
(3) No action may be taken on the applicable
proposed project until the Negative Declaration has been
reviewed and considered by the decision making body."
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted by the Council
of the City of Alameda in regular meeting assembled on the 19th day
of February, 1980, by the following vote, to wit;
