ORDERING VACATION OF PORTIONS OF ROADWAY EASEMENTS
(FERNSIDE BOULEVARD) (0.01 OF AN ACRE, MORE OR LESS)
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that
those portions of certain easements for public street and road-
way right-of-way, hereinafter referred to as "Fernside Boulevard"
situate in the City of Alameda, County of Alameda, State of
California, as conveyed to the City of Alameda by Grants of Ease-
ment recorded August 16, 1976, on Reel 4486, Image 813, and
September 7, 1976, on Reel 4515, Image 709, Official Records of
Alameda County, and described as follows:
COMMENCING at the point of intersection of the northwestern
line of the San Leandro Basin, as said line is shown
on "Map No. 2 of Salt Marsh and Tide Lands, situate
in the County of Alameda, State of California, 1871",
certified copies thereof having been filed with the
County Recorder of the City and County of San
Francisco, and in the office of the Department of
Finance, Division of State Lands, with the southwestern
line of Block "C", Tract 1849, as shown on the map
thereof recorded June 6, 1958 in Map Book 38, page 87,
Alameda County Records;
THENCE along said northwestern line, South 49°0611" West,
917.78 feet (recorded 917.46 feet) to intersection
with the southeasterly prolongation of the center line
of Washington Street;
THENCE North 47°4035" West along said center line, 447.17
feet (recorded 446.97 feet) to a point on the south-
eastern line of said Fernside Boulevard, being on the
arc of a curve concave to the Northwest and having a
radius of 844.00 feet, (a radial line from which point
bears North 45°06'45" West), being also the TRUE POINT
OF BEGINNING,
THENCE southwesterly along said southeastern line and said
arc, 30.06 feet through a central angle of 2°02'26", to
a point on a line parallel with and 30.00 feet south-
westerly at right angles from said center line of
Washington Street;
THENCE North 47°4035" West, along said parallel line, 10.76
feet to a point on the arc of a non-tangent curve con-
cave to the Northwest, having a radius of 644.00 feet
(a radial line from said point bears North 35°5433"
West);
THENCE northeasterly along said arc, through a central angle
of 5°24'27", 60.78 feet to intersection with a line
parallel with and 30.00 feet northeasterly at right
angles from the aforesaid center line of Washington
Street;
THENCE South 47°4035" East, along said parallel line,
3.90 feet to a point on the said southeastern line
of Fernside Boulevard (a radial line from said
point bears North 47°09'00" West)7
THENCE southwesterly along said southeastern line and arc
(non-tangent) ,30.01 feet through a central angle of
2°0215, to the TRUE POINT OF BEGINNING.
Containing 0.01 of an acre, more or less.,
are hereby ordered vacated pursuant to the provisions of Section
50443, Government Code of California.
BE IT FURTHER RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the said portions of
roadway easements ordered vacated herein are unnecessary for
present or prospective public use and (2) that said portions of
roadway easements have never been used by the City of Alameda
for any purpose whatever since August 13, 1976, and August 31,
1976, the dates of their acceptance by the City, to the date of
this resolution.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 15th day
of April, 1980, by the following vote, to wit:
AYES: Councilmen Diament, Sherratt, Stone,
Tillman and President Corica - 5.
NOES; None.
ABSENT: None.
