Resolution 09369CITY OF ALAMEDA RESOLUTION NO. ? = "a" STATING AND REQUESTING CONSOLIDATION OF A SPECIAL MUNICIPAL ELECTION TO BE HELD TUESDAY, NOVEMBER 4, 1980, WITH THE STATE OF CALIFORNIA GENERAL ELECTION TO BE HELD TUESDAY, NOVEMBER 4, 1980 (CHARTER AMENDMENT ON PETITION OF ELECTORS REGARDING COMPULSORY ARBITRATION AND CHARTER AMENDMENT REGARDING FUNDING OF EXCESS ARBITRATION AWARDS) BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that pursuant to the provisions of Chapter 4, Part' 2, Division 12, of the Elections Code of California, and of Section 23302 thereof, and pursuant to Article;XIX of the Charter of the City of Alameda, a Special Municipal Election for the purpose of submitting to the qualified voters of the: City two Charter amendment measures as set forth in the statement of the questions below, be consolidated with the State of California General Election to be held on Tuesday, November 4, 1980. BE IT FURTHER RESOLVED that the 'elcot ion precincts, polling places, voting booths, and election officers who shall conduct said Special Election are hereby designated to be the same as the election precincts, polling places; voting booths, and election officers as shall be designated, established and appointed by, resolution or ordinance of the Board of Supervisors of the County of Alameda for the purpose of holding and conducting said General Election within the territory affected by this order of consolida- tion, and that said election shall be held in all respects as if there were only one election. BE IT FURTHER RESOLVED that the Board of Supervisors of said County of Alameda is hereby authorized and empowered to canvass the returns of said Special Municipal Election and certify the results thereof. BE IT FURTHER RESOLVED that the Board of Supervisors of the County of Alameda, be and it is hereby , requested to make its order and to take such other and further proceedings as may be of said Special Election lection, all in accordance regulating and providing necessary to effect the consolidati with said State of California Genera: with the laws of the State of Califor for the consolidation of elections. BE IT FURTHER RESOLVED that the exact form of the measures to be voted on at` said ,Special Election, and as the same are to appear on the ballot, is as follows: MEASURE B: Charter Amendment Shall the Charter of the City of Alameda be amended to provide that no additional financial burdens may be imposed on the tax- payers of the City as a result of binding fact finding, arbitration or parity without approval of the voters by providing that no wages, benefits or employee related expenses shall be paid by the City that have not been approved by a resolution of the City Council until additional revenues and appropriations therefor have been approved by a vote of the people pursuant to Proposifion 13 (Jarvis- Gann Initiative) and Proposition 4 (Gann Initiative)? Said amendment will be accomplished by adding Section 17-17 to Article XVII of the Charter, all as fully set forth in Resolution No 34(1--(5f the Council of the City of Alameda. MEASURE C: Charter Ampndme Shall the Charter of the City of Alameda be amended to provide that firefighters' wages, hours and working conditions shall be established by compulsory and binding arbitration where negotiations required by said Charter amendment do not produce agreement with the City and to provide for the discharge of firefighters who willfully engage in strikes prohibited by said amendment? Said amendment will be accomplished by adding Sections 27-1 through 27-4 to a new Article XXVII of the Charter, all as fully set forth in Resolution No of the Council of the City of Alameda. NO : YES : NO : BE IT FURTHER RESOLVED that the measures hereinabove re- ferred to shall be designated on the ballot as "Proposed Amendments to the Charter of the City of Alameda, California." BE IT FURTHER RESOLVED that the City Clerk of the City of Alameda is hereby directed to immediately file with the Board of Supervisors, County of Alameda, State of California, this Resolution, duly certified by said City Clerk, and file a copy of said certified Resolution with the County Clerk of the County of Alameda, State of California. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and Passed by the Council of the City of Alameda in regular meeting assembled on the 19th day of August, 1980 by the following vote, to wit: AYES: Councilmen Diament, Stone, Tillman and President Corica - 4.
