AUTHORIZING EXECUTION OF AN AGREEMENT WITH ALAMEDA
CITY DISPOSAL CONSEN'T'ING TO TRANSFER OF THE SOLID
WASTE DISPOSAL AGREEMENT BETWEEN THE CITY AND ALAMEDA
CITY DISPOSAL TO OAKLAND SCAVENGER COMPANY
WHEREAS, Resolution No 8981, adopted September 19, 1978,
authorized a Solid Waste Disposal Agreement between the City and
Alameda City Disposal, thereafter executed September 28, 1978,
which granted exclusive rights for a period of ten years to
collect, remove and dispose of all solid waste accumulating in the
City of Alameda that i.'s required to be accumulated and offered for
collection to Disposal company in' accordance with legislation; and
WHEREAS Alameda City Disposal is negotiating and desires to
sell all capital stock in its company to Oakland Scavenger Company,
a California corporation; and
WHEREAS, Oakland Scavenger Company i_s a financially respon-
sib lc: corporation and is willing and able to undertake and carry
out the Solid Waste Disposal Agreement with the City, and
WHEREAS, an agreement entitled "Consent to Transfer Solid
Waste Disposal Agreement" has been submitted to this Council and
the Council is fully informed and aware of the terms and conditions
thereof; and
WHEREAS, it is in the best; public interest that said consent
be given and said agreement be entered into;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Mayor is hereby authorized and directed to
execute for and on behalf of the City of Alameda that certain
Agreement referred to above by and between the City and Alameda
City Disposal wherein the City consents to the transfer and
assumption of all rights and obligations under Alameda City
Disposal's Solid Waste Disposal Agreement with the City to Oakland
Scavenger Company. The City Clerk is hereby directed to attest to
same.
BE IT FURTHER RESOLVED that the effective date of said
Agreement shall be April 1, 1981.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the
Council of the City of Alameda in regular meeting assembled
on the 7th of April, 1981, by the following vote, to wit:
AYES: Councilmen Diament, Sherratt, Stone, Tillman and
President Corica - 5.
NOES: None.
ABSENT: None.
