Resolution 09521CITY OF ALAMEDA RESOLUTION NO. 9521 AUTHORIZING EXECUTION OF A 3200 DWELLING UNIT COVENANT BETWEEN THE CITY AND HARBOR BAY ISLE ASSOCIATES WHEREAS, the developer of in the City of A arbor Bay Ts certain real ameda; and Associates, hereinafter HBI, property located on Bay Farm Is nd WHEREAS, the City of Alameda has requested that HBI restrict and limit the number of dwelling' units that HBI and its successors in interest and assigns may seek approval for, construct, o.r cause to be constructed on its property; and WHEREAS, to confirm said dwelling unit restriction covenant in writing, a 3200 Dwelling Unit Covenant has been prepared and submitted to this Council, and the Council is fully informed and aware of the terms and conditions thereof; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Mayor is hereby authorized and directed to execute, for and on behalf of the City of Alameda, that certain 3200 Dwelling Unit Covenant referred to above by and between the City of Alameda and Harbor Bay Isle Associates. The City Clerk is hereby directed to attest to same. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 7th of April, 1981, by the following vote, to wit: AYES: Councilmen Diament, Sherratt, Stone, Tillman and President Corica - 5.
