Resolution 09609CITY OF ALAMEDA RESOLUTION NO, 9609 ACCEPTING PROPOSAL AS MODIFICATION OF AGREEMENT (BURTON Na CROWELL, COORDINATION OF AGENCIES AND SERVICES FOR PATTON WAY PROJECT) WHEREAS, on February 4, 1980, this City entered into an agreement with Burton N. Crowell for his professional services in the coordination of agencies and services for the improvement of Patton Way and WHEREAS, the preparation of an Environmental Impact Statement is now required which was not originally included in the scope of the project; and WHEREAS, Burton N. Crowell has presented a Proposal for modification of his agreement with -the City to provide for his services until completion of the EIS; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the proposal o Burton N. Crowell, Civil Engineer; dated June 5, 1981; a copy of which is attached; provide his services in the coordination of agencies and services for he Patton Way ,Improvement Project until completion of the EIS, is hereby accepted; and BE IT FURTHER RESOLVED that said proposal and this acceptance shall constitute the modification to the agreement entered into between Burton N. Crowell and the City on February 4, 1980. BE IT FURTHER RESOLVED that this acceptance is approved subject to Alameda Marina Village Associates "reimbursing the City for said services. At thn present time and on the -basis of out trages to this point, I am. reasonably close to my anticipateu . budget and .without the year's increase in. time engendered by the •Feds.' EIS requirement, could complete the projc ct. on the basis provided in the. contract ocluitably for both the city and myself.• There have been several project delays ovor which 1 had no control. F±rst, the contractor/subcontractor dispute with our original environmental consultant, which delayed document one to two months. Second, the protracted Planning Board hearing process which extended from late September, 1980 through late January, 1981, almost' four months. And now, preparation of an EIS for the Feds. which will add a year to the project schedule. I would propose that my contract be modified to compensate me on an hourly basis until the EIS is completed as allowed for in articles 5 & 6 of my contract. I don't anticipate .aa-heavy work load during this time. Therefore, I would r,- •suggeSt $50.00 per hour up to a maximum of $5000.00. After completion of the EIS, terms would revert to those of the original contract with an-amnended completion date as outlined in articles 2 & 5.
