Resolution 09669CITY OF ALAMEDA RESOLUTION NO. 9669 AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION AND COMPLETION OF IMPROVEMENTS IN CONNECTION WITH SUBDIVISION TRACT 4136 AND APPROVING BONDS AS TO SUFFICIENCY (PONDEROSA HOMES, SUBDIVIDER) WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, Ponderosa Homes, a General Partnership, owner and subdivider herein, and Ronald H. Cowan, owner, have prepared and presented to this Council the Final Map of the subdivi- sion known as Tract 4136; and WHEREAS, subdivider has entered into an agreement to con- struct and complete the improvements in said subdivision, has filed the Final Map, thereof for approval at this time, and has posted its bonds guaranteeing full and faithful performance of said work, all in accordance with said Article; and WHEREAS, it will be to the advantage and benefit of the City to have said work performed in accordance with said agree- ment. NOW, THEREFORE, BE IT RESOLVED -BY THE COUNCIL OF THE CITY OF ALAMEDA that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions be, and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to respectively, said agreement on behalf of the City of Alameda. DE IT FURTHER RESOLVED that the bonds in the sums of $585,000, guaranteeing full and faithful performance of the sub - divider's said public improvements construction contract, are hereby approved as sufficient in amount. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 19th of January, 1982, by the following vote, to wit: AYES: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. NOES: None. ABSENT: None. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the official seal of said City this 20th day of January, 1982.
