Resolution 09705CITY OF ALAMEDA RESOLUTION NO. q7n5 ORDERING VACATION OF SANITARY SEWER EASEMENT LOCATED AT INTERSECTION OF FERNSIDE BOULEVARD AND WASHINGTON STREET WHEREAS, by its Resolution No. 9685, regularly adopted February 2, 1982, this Council declared its intention to vacate that certain sanitary sewer easement hereinafter more particularly described, all in accordance with Provisions of the Public Streets, Highways, and Service Easements Vacation Law (Sections 8320 and following of the Streets and Highways Code of California), and thereafter caused publication and posting of notices of said intended vacation as required by said Law, both said Publication and notices fixing the time and place for hearing all persons interested in the vacation as Tuesday, March 2, 1982 at 7.30 P.M. in the Council Chamber, City Hall, Alameda, California; and WHEREAS, at said time and place the matter of the proposed vacation came on regularly for hearing by this Council at its regular meeting, and proof of publication and of posting of said notices in the manner required by law having been made by the City Clerk, and the Council then having heard all the evidence, both oral and documentary, proferred by all persons interested in said matter, and the Council being fully advised in the premises and the matter thereupon submitted for determination; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that: (1) It is hereby found and determined that the sanitary sewer easement in said Resolution of Intention and hereinafter particularly described is unnecessary for present or prospective public use, and the public interest requires vacation of same; (2) It is hereby ordered that the following sanitary sewer easement be, and it is, vacated: COMMENCING at the point of intersection of the northwestern line of East Shore Drive with the southwestern line of Block "D" of Tract 1849, as shown on the map thereof filed June 6, 1958, in Book 38 of Maps, Page 87 thereof in the office of the Alameda County Recorder; THENCE along the last said line, North 47° 40' 22" West, 392.84 feet to the western corner of lot 8 of said Block "D"; THENCE southwesterly along a non-tangent curve having a radius of 1,000 feet, whose center bears South 47° 39' 08" East, through a central angle of 3° 37' 27" to a point of reverse curvature, a distance of 63.26 feet; THENCE southwesterly along a curve having a radius of 1,000 feet, through a central angle of 3° 37 27", a distance of 63.26 feet; THENCE tangent to said curve South 42° 20' 52" West, 757.18 feet to the beginning of a tangent curve concave northwesterly; THENCE southwesterly along last said curve having a radius of 844 feet, through a central angle of 2° 32' 23 ", a distance of 37.41 feet to the southeasterly pro - longation of the centerline of Washington Street as said street is shown on the "Map of the Town of Alameda and Adjacent Lands", filed September 12, 1867, in Book 5 of Maps, page 16, in the office of the Alameda County Recorder; THENCE along said prolongation North 47° 40' 35" West, 5.76 feet to the TRUE POINT OF BEINNING for this description; THENCE South 88° 52' 11" West, 43.61 feet; THENCE North 47° 40' 35" West, 91.34 feet; THENCE South 42° 17' 06" West, 235,00 feet; THENCE North 47° 40' 35" West, 10.00 feet; THENCE North 42° 17' 06" East, 245.00 feet; THENCE South 47° 40' 35" East, "97.35 feet; THENCE North 88° 52' 11" East, 29.07 feet; THENCE South 47° 40' 35" East, 14.54 feet to the TRUE POINT OF BEGINNING. BE IT FURTHER RESOLVED that the City Clerk shall cause a certified_ copy of this order, attested under seal., to be recorded in the County Recorder's Office, and from and after the date of said recordation the sanitary sewer easement vacated no longer shall constitute a sanitary sewer easement. -2-- I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on 2nd of March, 1982, by the following vote to wit: AYES: Coucilmen Diament, Gorman, Sherratt, Stone and President Corica - 5.
