Resolution 09725CITY OF ALAMEDA RESOLUTION NO. 9725 DETERMINING THAT PREVIOUS ENVIRONMENTAL ASSESSMENTS ARE ADEQUATE FOR THE REVISED HARBOR BAY PARKWAY EXPANSION PROJECT, INCLUDING THE DOOLITTLE DRIVE INTERSECTION WHEREAS, this Council certified the Final EIR prepared by Arthur D. Little, Inc. for the Harbor Bay Isle development on March 5, 1975, which included City Line Road as a mitigation measure and noted that expansion of Doolittle Drive could have adverse impacts on wildlife habitats; and WHEREAS, this Council certified the Final EIR prepared by Environmental Impact Planning, Inc. for the City's Combined Land Use Plan(CLUP) in March, 1979, which proposed and analyzed an expanded City Line Road and noted that changes in wildlife habitat on vacant areas would result from full implementation of the recommendations of CLUP; and WHEREAS, this Council by Resolution No. 9269 on April 1, 1980 determined that the HBI EIR, as supplemented by CLUP and the General Plan, provided sufficient environmental assessment pursuant to CEQA regulations for Tract 4500 and an EDA G rant proposal for the HBI Business Park intrastructure; and WHEREAS, the City performed additional environmental analysis for the EDA Grant application for the Harbor Bay Parkway Expansion Project, which project was circulated to the federal and state Clearinghouses and cleared without adverse comment in March and April, 1981, respectively; and WHEREAS, preliminary design details of the Harbor Bay Parkway/ Doolittle Drive intersection as part of a revised project description were presented to and approved by the EDA, as reflected in the City's Agreement Regarding Harbor Bay Parkway Expansion Project entered into December 16, 1981, pursuant to this Council's Resolution No. 96567 and WHEREAS, improvement plans were prepared for the Harbor Bay Parkway/Doolittle Drive intersection to provide traffic signal con- trols and additional turning lanes to increase traffic safety in anticipation of HBI Business Park truck and automobile traffic; and WHEREAS, as part of the construction permit process for the Harbor Bay Parkway Expansion Project, a site visit to the Harbor Bay Parkway/Doolittle Drive intersection by representatives of state and federal agencies noted that the proposed turning lanes would place fill in the southeast corner of the intersection in a wetlands area with habitat value for fish and wildlife, and that such dis- turbance or loss should be mitigated by locating an alternate area that can be converted to wetlands and perpetually designated as such; and WHEREAS, the proposed improvements of this intersection pro- vide a critical link in the proposed bicycle circulation system on Bay Farm Island that will eventually connect the Harbor Bay Isle shoreline bike path, the Harbor Bay Parkway bike path, and a future San Leandro Bay bike path also, use of such bike circulation system mitigates the impacts of automobile use and furthers maximum public access to San Francisco Bay; and WHEREAS, City staff has arranged for the circulation of the attached "Supplemental Environmental Information Statement" and "Proposed Mitigation for Doolittle Drive Intersection" to appropriate state and federal agencies; and WHEREAS, the relatively minor size of the affected wetlands area (approximately 33 acres) its non - strategic location on the landward side of Doolittle Drive away from Doolittle Pond, the physical availability of a mitigation parcel close at hand, and the general attention to impacts on wiidiife habitats given in the HBI EIR and CLUP EIR lead to the determination that CEQA regulations would require neither an additional EIR nor a Negative Declaration as if this were a new project; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby determines that the Final EIR for Harbor Bav Isle, the EIR for CLUP, and the environmental assess- ment activities in conjunction with Tract 4500 and the City's EDA Grant proposal are adequate environmental assessment for the revised Harbor Bay Parkway Expansion Project, including the Doolittle Drive intersecton, PLANNING DEPARTMENT CITY OF ALAMEDA CALIFORNIA CITY HALL • SANTA CLARA AT OAK STREET 94501 • (415) 322-4100 HARBOR BAY PARKWAY EXPANSION PROJECT SUPPLEMENTAL ENVIRONMENTAL INFORMATION STATEMENT FOR DOOLITTLE DRIVE INTERSECTION 1. The Alameda City Council on April 1, 1980 determined that previous environmental assessments were sufficient to proceed with the development of the Harbor Bay Isle Business Park, which included the Harbor Bay Parkway Expansion Project. This determination was based on the existing environmental base. The Environmental Impact Report on the entire Harbor Bay Isle development prepared by Arthur D. Lit-61e, Inc. and certified by the City of Alameda in 1975, proposed the construction of City Line Road (now Harbor Bay Parkway) as a mitigation measure for industrial park traffic connecting to Doo- little Drive and the regional transportation network. The Environmental Impact Report on the Combined Land Use, Open Space, and Circulation Elements of the City of Alameda's General Plan prepared by Environmental Impact Planning, Inc. and certified by Alameda in 1979 (the "CLUP EIR") analyzed City Line Road (p.224) and noted that "a change in wildlife habitat on vacant areas would result from full implementation of the recommendations of the Plan." (p.208) These EIR's were supplemented by the San Leandro Bay Transportation Study, the JFK Traffic Studies for the HBI Business Park in 1980, and aircraft-related noise studies for HBI prepared by M.A.G. Consultants, Inc. in 1980. 2. The report "Protection and Restoration of San Francisco Bay Fish and Wildlife Habitat" issued by the U.S. Fish and Wildlife Service and the California Department of Fish and Game in 1979 classifed an area in the southeast corner of the Harbor Bay Parkway/Doolittle Drive inter- section as a "ruderal" habitat with potential wildlife values. No rare or endangered species were identified for the area. 3. As part of the grant application to the U.S. Department of Commerce's Economic Development Administration (EDA) for funding the Harbor Bay Parkway Expansion Project, the project was filed with ABAG for A-95 Review on January 20, 1981, assigned number 3986, and cleared without comments on March 19, 1981. On February 2, 1981, the project was filed with the State Clearinghouse, assigned number 810-20313, and cleared in April, 1981, with only one comment: a clearance letter specially requested from the State Historic Preservation Officer. The EDA determined that adequate environmental review of the project had been performed. 4. The intersection improvements are proposed for improved traffic safety in anticipation of traffic generated by the Harbor Bay Isle Business Park, which traffic has been adequately analyzed in previous environmental assessments and traffic studies. The intersection improvements do not generate any additional traffic or modify projected traffic allocations or splits of business park traffic. The intersection improvements do not involve any traffic-related environmental impacts not adequately add essed in previous environmental assessments. 5. As part of the construction permit process for the Harbor Bay Parkway Expansion Project, a field investigation of the Harbor Bay Parkway intersection with Doolittle Drive by various agency representatives on March 2, 1982 determined certain flora in the contiguous lowlands in the southeast corner of the intersection indicated a wetlands area with ruderal habitat value for fish and wildlife. The site visit by representatives of CALTRANS, BCDC, the Army Corps of Engineers, EPA, U.S. Fish and Wildlife Service, California Department of Fish and. Game, City of Alameda and the Port of Oakland adequately analyzed the nature and scale of potential environmental impacts. The relatively minor size of the affected area (approximately .33 acre), its nonstrategic location, and the physical availability of immediately contiguous property for mitigation of any loss of habitat value lead to the reasonable conclusion that the proposed intersection improvements will not have a significant effect on the environment. 3/23/82 -2- 6. The City of Alameda is working with the Port of Oakland as the property owner of the contiguous area available as a mitigation parcel and with the agencies involved to effect a substitution of land on 1:1 basis. 7. The Army Corps of Engineers permit and the B.C.D.C. permit circulation processes provide sufficient review and a mechanism to establish adequate mitigation without the necessity for additional formal environmental review. 3/23/82 rf OF ALAMEDA RESOLUTION 9269 DETERMINING THE EXISTING FINAL ENVIRONMENTAL IMPAC? AND CERTIFIED BY TEE ALAMEDA CITY COUNCIL ON MARCH 5, 1975 AS SUPPLEMENTED BY THE COMBINED LAND, USE PLAN AND THE CITY GENERAL PLAN IS ADEQUATE TO COVER REVISED ULTIMATE PROJECT DESCRIPTION OF HARBOR BAY ISLE DEVELOPMENT WITH SPECIAL REFERENCE TO TRACT 4500 AND AN EDA GRANT PROPOSAL FOR THE BUSINESS PARK INFRASTRUCTURE WHEREAS, by its Resolution No. 8593 adopted on October 5, 1976, this Council resolved that a determination that the A. D. Little Report is adequate as to the Harbor Bay Isle ultimate project description would be necessary for each Harbor Bay Isle application as submitted; and WHEREAS, a Revised Ultimate Project Description f.(7.: Harbor Bay Isle Development, with special reference to Tract 45C) and an EDA Grant Proposal for a Business Park Infrastructure ba been submitted to the Planning Board; and WHEREAS, the Planning Board duly noticed and held -)ublic hearings thereon, and on March 20, 1980, by its Resolution No. 1055, determined that pursuant to Section 15067 of the Guidelines for the implementation of CEQA, no additional EIR need be pre- pared for the proposed project for Tract 4500, since the existing certified Final Environmental Impact Report prepared by A. D. Little, Inc., as supplemented by CLUP and City General Plan, is adequate to cover the revised ultimate project description of the Harbor Bay Isle development, with special reference to Tract 4500 and the EDA grant proposal for business park infrastructure; and WHEREAS, the City Council on April 1, :1980, held a hearing in the matter of the environmental determination for the'revised ultimate project description for Harbor Bay Isle with special reference to Tract 4500 and an EDA Grant Proposal for the Business Park Intrastructure, heard testimony and:took other evidence thereon, following which said Council considered the matter and was fully advised in the premises; NOW, ,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that. said Council hereby adopts the Findings entained in the Planning Board's Resolution No. 1055, adopted Marcll 20,. 1980, and determines that the existing Final Environmentel Impact Report prepared by A. There are no substantial environmental impacts not considered in the existing EIR's analytic framework. 3. The City's Noise Element and CLUP have updated the information in the existing EIR and refined mitigating measures within the existing EIR's analytic framework. The environmental assessment phase of City actions in adopting these elements of the General Plan has expanded the environmental data base for the ultimate project in a fashion consistent with the existing EIR. 4. The City has previously approved incremental changes in the ultimate project without requiring a new ETR. 5 The existing environmental data and analytic framework based on the existing EIR as supplemented by subsequent City studies and actions are sufficient to make an environmental determination on the proposed project for Tract 4500. 6 The proposed project for Tract 4500 incorporates appropriate, mitigating measures for environmental impacts analyzed in the existing EIR. 7. The proposed City Line Road improvements, pump stations and sewer lines have been considered previously by the Board and are • adequately treated by the A. D. Little EIR, Combined Land Use EIR and Noise Element EIR. 8. The City Line Road project in its general outline, is in conform- ance with the City's General Plan, adopted July, 1979. 9. The apPlicJnt for the proposed City Line Road improvements project is the City, and as such is subject to the A-95 review process whereby all public agencies affected will have the opportunity to analyze the project impacts. THEREFORE, BE IT RESOLVED, that the Planning -Board of the City of Alameda determines that pursuant to Section 15067 of the Guidelines for the implement- ation of CEQA, no additional EIR need be prepared for the proposed project for Tract 4500, since the existing certified Final Environmental Impact Report prepared by A. D. Little, Inc., as supplemented by CLUP and City General Plan, is adequate to cover the revised ultimate project descrip- tion of the Harbor Bay Isle development, with special reference to Tract 4300 and the, EDA grant proposal for business park infrastructure. In making this determination, the Planning Board further states: 1. This determination is not an approval of the merits of any of the applicant's proposed design, planning, engineering, or public • policy proposals. 3. The City reserves the right to require any additional information needed to review applications filed within the processing of Tract 4500. 4. This determination specifically allows the City to apply for an EDA grant without further environmental assessment. We have reached several conclusions as a result of this analysis. With the Business Park Development containing approximately 10,000 parking spaces, there are several roadway improvements which need to be implemented at certain stages of the development. First of all, Doolittle Drive, which is a State Highway, should be constructed into a four-lane cross section east of Harbor Bay Parkway. Secondly, Harbor Bay Parkway also needs to be widened to a four-lane roadway. For the 10,000 parking spaces proposal, Harbor Bay Parkway will have an ADT of 28,000 vehicles per day. The break point in which the widening should occur is when Harbor Bay Parkway volumes reach between 20,000 and 24,000 vehicles a day. This is equivalent to approximately 75-80% of the Business Park being developed. The precise points depend on the extent of any future side friction along the existing Harbor Bay Parkway and whether new driveway entrances are connected. In all of our traffic analyses, Doolittle Drive (the State Highway) consistently is estimated to have a higher ADT than Harbor Bay Parkway. Doolittle Drive, therefore, needs to be widened at a point in time before the widening of the existing Harbor Bay Parkway is required. In no case does Harbor Bay Parkway need to be widened without correspon- ding improvements in the State Highway, Doolittle Drive. Doolittle Drive involve the placement of 5,000 cubic yards of fill in the southeast corner of the intersection. A portion of the fill, approximately 3,000 cubic yards, will cover 14,800 square feet of lowlands. This approximately .33 acre area has been recently identified through a field investigation by various agency naturalists and environmental specialists as wetlands with pickleweed growth and habitat value for fish and wildlife. To mitigate this loss of wetlands, an uplands area of roughly 15,000 square feet lies immediately to the south, between the wetlands and the Oakland Raiders training field. If the Port of Oakland as landowner agrees to make this area available as a mitigation parcel, the uplands area will be excavated to an elevation that will promote appropriate growth with habitat value for fish and wildlife and be legally designated as a perpetual wetlands area.
