Resolution 09770RIGINAL RESOLUTION NO, 9770 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALAMEDA, CALIFORNIA, ESTABLISHING THE SCHEDULE FOR RATES AND CHARGES FOR CABLE TELEVISION SERVICE UNDER A NON-EXCLUSIVE FRANCHISE TO BE GRANTED TO UNITED CABLE TELEVISION OF ALAMEDA, INC. CITY OF ALAMEDA WHEREAS, the City Council of the City of Alameda anticipates granting a non-exclusive franchise to allow construction, operation and maintenance of a Community Antenna Television (CATV) system within the City of Alameda; and WHEREAS, the Section 11, of Ordinance 2065, allows that one of the conditions in the granting of a CATV franchise may be the establishment by the Grantor, on a not to exceed basis, the rates and charges associated with CATV service; and, specifies the procedures for the petition by the Grantee for increase in service rates and charges; and WHEREAS, United Cable Television of Alameda, Inc. in its franchise application proposed certain service rates and charges, guaranteed for a specified period, as a condition of its being awarded a CATV franchise to serve the City of Alameda. NOW, THEREFORE, BE IT RESOLVED, that the City Council established the Grantee's service rates and charges schedule, which is effective until the expiration of Grantee's rate guarantee as defined herein and either at such time as Grantee elects to raise its rates for cable service as permitted in Section 11, of Ordinance 2065, or preempted by State or Federal regulations. The service rates and charges established are as follows: 1. The United Cable Television of Alameda, Inc. schedule of service rates and charges for subscribers, residential and institutional, except as modified elsewhere herein, is as follows: Page 1 A. H. Basic and Premium Service rates and charges are discounted 15% for Senior Citizens. I. All service installations, including converter installation, shall be waived for residential subscribers for Basic and Premium services ordered during the first ninety (90) days following notification of the resident that such service is available to the residence, with the exception that underground installations will cost $10.00 during that- period. FM, Simulsound, Playcable, converter remote control device, and Premium service installations will be at no cost when installed at the same time as Basic service. J. Installation of drops of over 150 feet in length may be charged at a maximum of $14.95 plus the cost of drop materials beyond 150 feet for aerial installation. Page 3 Underground drops of over 150 feet at standard cost plus time and materials for that portion beyond 150 feet. Installation cost estimates shall be provided in writing to potential subscribers prior to installation where drops exceed 150 feet. K. The above rates and charges (subsection A through J immediately above) are guaranteed by Grantee as fixed for a period of two years from date of initial activation of service, with the exception that Basic Service rates and charges are guaranteed by Grantee for three (3) years from initial activation of service. L. All other service rates, charges and/or determination of same will be in accordance with the specifications and spirit of Grantee's franchise application, and the Franchise Agreement which includes this Resolution. M. Grantee will coordinate with media to see that a comprehensive program guide is available to subscribers. In the event the media does not make such a guide available, Grantee will make every reasonable effort to make such a guide available through convenient commercial outlets, such as supermarkets. 2. All private and public schools, with an enrollment of fifty (50) or more students, and City government buildings will be provided free basic connection and free Basic service, at Tier III level, for education purposes except, however, such users shall be responsible for converters in the same manner as subscribers. In addition to other considerations for public schools, each public school shall receive up to three (3) drops and three (3) outlets. Each City government building shall receive one (1) drop and one (1) outlet. Each private school with an enrollment of fifty (50) or more students shall receive one (1) drop and one (1) outlet. Chosen drop locations should be at reasonably accessible locations. Any additional drops will be on a time and materials cost basis. The City or entity involved will provide whatever easements may be necessary for Grantee to provide such service. The reference to schools in this Section and Section 10.6(B)(1) of the Ordinance No. 2065 is hereby expanded to include parochial and other private non-profit schools, with an enrollment of fifty (50) or more students. 3. There will be no charge or fees for installation of bi- directional cable drops into City government buildings and offices, for data transfer, facsimile transfer, and other cable communications requirements when and as requested by the City Manager's office. Grantee shall have a reasonable time to respond to City Manager's request. Page 4 4. It is acknowledged by the Grantor that Federal regulations preempt the regulation of rates and charges for services other than Basic Service and that the rates for services other than Basic are listed herein to reflect Grantee's rate guarantee as specified above.
