Resolution 09900CITY OF ALAMEDA RESOLUTION NO, 9900 APPROVING ALTERNATE MITIGATION FOR ARMY CORPS OF ENGINEERS FOR DOOLITTLE DRIVE AND HARBOR BAY PARKWAY INTERSECTION WHEREAS, the Army Corps of Engineers requires as a condition of permit for the improvement of the intersection of Doolittle Drive and Harbor Bay Parkway the replacement of lost fresh water marshland as specified by the U.S. Fish and Wildlife Service; and WHEREAS, the most feasible location for a wildlife preserve is located within the City -owned and bounded by Harbor Bay Park- way, Maitland Drive and the Port of Oakland property line, as shown on Exhibit "A" attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that 1. The City of Alameda does hereby dedicate the 2.25 acre site as set forth in Exhibit "A" in perpetuity as a wildlife preserve; 2. The City of Alameda will retain ownership of the wild- life preserve and will be responsible for maintaining existing wildlife values on the site in perpetuity; 3. The City of Alameda will prevent contamination of waters within the wildlife preserve by leachate created during storage of wood chips in waters on the remainder of City property. Storage of wood chips in adjacent water channels shall not be grounds for objecting to or preventing inundation of the channel within the wildlife preserve.
