AUTHORIZING EXECUTION OF AN AGREEMENT WITH ENCINAL
INDUSTRIES, INCORPORATED RELATING TO MODIFICATION
OF BUILDINGS LOCATED ON PROPOSED LOT LINES AND THE
GRANT OF CERTAIN EASEMENTS IN CONNECTION WITH
APPROVAL OF PARCEL MAP NO. 2938
WHEREAS, Encinal Industries, Incorporated, a California
corporation, has presented Parcel Map No. 2938 to the Council
for approval; and
WHEREAS, approval of said Parcel Map is conditioned on
Encinal Industries, Incorporated entering into an agreement
with the City to delay the dedication of easements and the
alteration, moving, or demolition of buildings crossing newly
established parcel lines until implementation of all or portions
of the Encinal Terminal Master Plan or sale of a related parcel;
and
WHEREAS, a proposed Agreement has been submitted to this
Council, and the Council is fully informed and aware of the
terms and conditions thereof;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF ALAMEDA that the City Manager is hereby authorized and
directed to execute, for and on behalf of the City of Alameda,
that certain agreement referred to above by and between Encinal
Industries, Incorporated and the City of Alameda to delay the
modification of buildings located on proposed lot lines and
the grant of certain easements in connection with Parcel Map
No. 2938. The City Clerk is hereby directed to attest to same.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd of May, 1983,
by the following vote to wit:
AYES: Councilmembers Diament, Gorman, $herratt, Stone and President Corica - 5.
NOES: None.
ABSENT:None.
