Resolution 10139CITY OF ALAMEDA RESOLUTION NO. 10139 REJECTING ALL BIDS RECEIVED FOR CONSTRUCTION OF THE ALAMEDA CORPORATION YARD AND ANIMAL SHELTER, CALLING FOR NEW BID PROPOSALS AND DIRECTING CITY CLERK TO ADVERTISE SAME WHEREAS, on July 19, 1983, the City Council called for bids for the combined projects of the Alameda Corporation Yard and Animal Shelter; and WHEREAS, three bids were submitted for construction of the Corporation Yard and Animal Shelter; and WHEREAS, MGC's submission was before 2:00 P.M., CSB's submission was at 2:02 P.M., and Pacific/Fields' submission was at 2:06 P.M.; and WHEREAS, the Public Works Director determined that it was in the best interest of the City to open all bids; and WHEREAS, all bids were deficient in information unrelated to the work to be done and the amount to be paid; and WHEREAS, the Public Works Director determined it was in the best interest of the City to allow an additional 22 hours for all bidders to submit complete information; and WHEREAS, Pacific/Fields is the low bidder and submitted all information by 12 o'clock on August 2, 1983; and WHEREAS, an award of the contract to the low bidder has been challenged; and WHEREAS, Pacific/Fields is reluctant to accept award of a construction contract which could be jeopardized by legal action; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby rejects all bids received and opened on August 1, 1983 in response to its call for bids for the Construction of the Alameda Corporation Yard and Animal Shelter; and BE IT FURTHER RESOLVED that said Council will receive sealed bids up to the hour of 2:00 o'clock p.m. on TUESDAY, AUGUST 30, 1983, for the Construction of the Alameda Corporation Yard and Animal Shelter in strict accordance with the Request for Proposals, a copy of which document may be obtained by any prospective bidder on application to the Public Works Director, at his office in the City Hall, Alameda, California. Bids must be presented to the City Clerk in the City Hall, Alameda, California, under sealed cover and plainly marked on the outside, "Proposal for Construction of the Alameda Corporation Yard and Animal Shelter," or similar designation. Contract, if awarded, will be awarded subject to the provisions of the Charter of the City of Alameda, to the respon- sible bidder who submits the lowest and best bid. The right is reserved to reject any or all bids. The City Clerk is hereby directed to advertise, in the Alameda Times-Star, a notice calling for sealed bids, in accordance with the provisions of this resolution. I, the undersigned, hereby certify that the foregoing resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular adjourned meeting assembled on the 22nd of August, 1983, by the following vote to wit: AYES: C0uncilmemberS Gorman, Hanna, Monsef and President Diament - 4.
