Resolution 10170CITY OF ALAMEDA RESOLUTION NO. 10170 FINDING AND DETERMINING LEANDRO STREET AND PORTIONS OF MARKET STREET, PUBLIC STREETS IN THE CITY OF ALAMEDA, ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES; FINDING NO RESERVATION OF EASEMENT THEREIN NECESSARY; ORDERING THE VACATION THEREOF AND DIRECTING CITY CLERK TO CAUSE CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED WHEREAS, the Council of the City of Alameda, did, on the 6th day of September, 1983, adopt its Resolution of Intention No. 10148 declaring its intention to order the vacation of 1. All of Leandro Street (60 feet wide, unimproved) and four separate parcels of excess property along Fernside Boulevard including portions of Leandro Street (abandoned), as more particularly described in Exhibit "A" attached hereto and made a part of this resolution; 2. A portion of Market Street northeasterly of Calhoun Street as more particularly described in Exhibit "E" attached hereto and made a part of this resolution; 3. A portion of the southwestern terminus of Market Street, as more particularly described in Exhibit "C" attached hereto and made a part of this resolution, and hereby finds and determines that public convenience and necessity do not require reservation by said City of any easements or rights of way in said portions of said streets; and WHEREAS, particulars of the proposed vacations are shown on the following maps on file in the office of the City Clerk: 1. That certain map entitled, "Leandro Street Abandon-- ment and Excess Property along Fernside Boulevard," prepared by the City Engineer, dated June, 1983, denominated Drawing 7876, Case 51, in the records of the City Engineer; 2. That certain map entitled, "Market Street Abandon- ment," prepared by the City Engineer, dated June, 1983, denominated Drawing 7875, Case 54, in the records of the City Engineer; 3. That certain map entitled, "Abandonment of Market Street South of Bridge View Isle," prepared by the City Engineer, dated June, 1983, denominated Drawing 7873, Case 54, in the records of the City Engineer; and WHEREAS, the City Clerk caused Notice of said proposed street vacation to be published and Notice thereof and of the time and place of hearing thereon was duly posted in accordance with the requirements of Part 3 of Division 9, of the Streets and Highways Code of California; and WHEREAS, proof of said publication is evidenced by the affidavit of publication now on file in the office of the City Clerk; and WHEREAS, proof of said posting of such notices is evidenced by the affidavit of the person posting said notices, and is now on file in the office of the City Clerk; and WHEREAS, the matter of said proposed vacations came on regularly for hearing before the Council of the City of Alameda at its regular meeting on the 4th day of October, 1983, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persons interested in said street vacations; and a full hearing thereon having been had and the matter submitted for determination; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that Leandro Street and portions of Market Street, in said Resolution of intention and hereinbefore more particularly described are unnecessary for present and prospective public street purposes and that public interest requires the vaca- BE IT FURTHER RESOLVED that Leandro Street and the portions of Market Street in said Resolution of Intention and hereinbefore more particularly described be, and the same are hereby vacated. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have a certified copy of this Resolution recorded in the office of the Recorder of Alameda County, California.
