Resolution 10240CITY OF ALAMEDA RESOLUTION NO. 10240 FINDING AND DETERMINING A PORTION OF SEA VIEW PARKWAY, A PUBLIC STREET IN THE CITY OF ALAMEDA, IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES; FINDING NO RESERVATION OF EASEMENT THEREIN NECESSARY; ORDERING THE VACATION THEREOF AND DIRECTING CITY CLERK TO CAUSE CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that a portion of Harbor Bay Parkway (also known as Sea View Parkway) and a portion of Sheffield Road, as shown on the map of Tract 3841, filed February 27, 1979 in Book 108 of Maps at pages 68 thru 76, Official Records of Alameda County (designated Parcel "A ") and all of Parcel 2, as shown on the map of Tract 3841, filed February 27, 1979 in Book 108 of Maps at pages 68 thru 76, Official Records of Alameda County (designated Parcel 2), all as more particularly described in "Exhibit A" attached hereto and made a part of this resolution, are hereby ordered vacated pursuant to the provisions of Article 1, Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8331 thereof. BE IT FURTHER RESOLVED that said Council hereby finds that there are no in -place public utility facilities in use that would be affected by this vacation. BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (a) for a period of five consecutive years, the portions of streets vacated have been impassable for vehicular travel and (b) no public money was expended for maintenance on the portions of streets vacated during such period. BE IT FURTHER RESOLVED that the City Clerk shall cause a certified copy of this order, attested under seal, to be recorded in the County Recorder's Office and from and after the date this resolution is recorded the portions of streets vacated no longer shall constitute a street. PROPOSED ABANDONMENT - PARCEL "A" REAL PROPERTY in the City of Alameda, County of Alameda, State of California, described as follows: Being a portion of Harbor Bay Parkway (also known as Sea View Parkway) and a portion of Sheffield Road, as shown on the map of Tract 3841, filed February 27, 1979 in Book 108 of Maps at pages 68 thru 76, Official Records of Alameda County, described as follows: BEGINNING at the northwest corner of Parcel 2, as shown on said map (3841); thence along the westerly line of said Parcel 2, South 0° 57' 59" West, 56.03 feet; thence along the easterly right -of -way line of said Sheffield Road, along the arc of anon- tangent curve to the left, the center of which bears South 1° 53' 59" East, having a radius of 20.00 feet, through a central angle of 87° 06' 01 ", a distance of 30.40 feet; thence continuing along said easterly right -of -way, tangent to the last described curve, South 1° 00' 00" West, 50.27 feet; thence along the arc of a tangent curve to the left, having a radius of 220.00 feet, through a central angle of 14° 19' 42 ", a distance of 55.02 feet to a point of cusp; thence leaving said easterly right -of -way, along the arc of a tangent curve to the right, having a radius of 370.00 feet, the center of which bears North 76° 40' 18" East, through a central angle of 13° 08' 06", a distance of 84.82 feet; thence, tangent to last described curve, North 0° 11' 36" West, 23.71 feet; thence along the arc of a tangent curve to the left, having a radius of 80.00 feet, through a central angle of 84° 09' 30 ", a distance of 117.51 feet to its intersection with the northerly right -of -way line of the aforementioned Harbor Bay Parkway, said intersection being a point of cusp; thence along said northerly right -of -way, South 84° 21' 06" East, 23.19 feet; thence along the arc of a tangent curve to the left, having a radius of 924.00 feet, through a central angle of 4° 37' 12 ", a distance of 74.50 feet to the point of beginning.
