AUTHORIZING EXECUTION OF EASEMENT AGREEMENT MODIFYING
USE OF AN EXISTING DRAINAGE EASEMENT IN BAYVIEW
ESTATES TO ALLOW UNITED CABLE TELEVISION OF ALAMEDA,
LTD. TO INSTALL LOCAL DISTRIBUTION UNIT AND RELATED
APPURTENANCES IN THE EASEMENT
WHEREAS, on August 30, 1961, South Shore Land Company,
developers cf Bayview Estates, granted a drainage and access
easement to the City of Alameda which includes a portion of the
property located at 2812 Bayview Drive; and
WHEREAS, United Cable Television of Alameda, Ltd. has re-
quested that said easement be modified to allow United to place
four Local Distribution Units and appurtenant cable conduits and
other facilities in the easement; and
WHEREAS, in the event the LDU's restrict City's access,
United has agreed to reimburse the City to the extent that the
City's costs are increased as a result of the restricted access;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
CF ALAMEDA that the Maycr and City Clerk are hereby authorized
to execute and to attest to, respectively, on behalf of the City,
an Easement Agreement with Jane Conner Prael and Richard L. Conner,
owners of the property at 2812 Bayview Drive, and United Cable
Television of Alameda, Ltd. to allow United to construct Local
Distribution Units and Appurtenances in the drainage easement at
Bayview Drive and providing for reimbursement to the City of any
increased costs as a result of restricted access.
BE IT FURTHER RESOLVED that said Easement Agreement shall
be substantially in the form of that heretofore filed in the office
of the City Clerk on February 7, 1984.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 7th of February, 1984,
by the following vote to wit:
AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and
President Diament - 5.
NOES: None.
ABSENT: None.
