CITY OF ALAMEDA RESOLUTION NO. 10255
CONSENT TO ASSIGNMENT OF LEASE TO ALAMEDA PACIFIC SHOPS,
INC., OF REAL PROPERTY HELD UNDER LEASE BY AND BETWEEN
THE CITY OF ALAMEDA AND JOHN BENTZEN. (3.501 ACRES
LOCATED ON NORTHEAST LINE OF CLEMENT AVENUE)
WHEREAS, on the 14th day of November, 1974, an assignment
of lease of certain real property owned by the City of Alameda was
entered into by and between the City of Alameda, as Lessor, and
John Bentzen, as Lessee; and
WHEREAS, said lease requires that the written consent of
the Lessor be first had and obtained prior to the assignment of
said lease to a third party; and
WHEREAS, John Bentzen has requested that the Council of the
City of Alameda consent to the assignment of said lease to Alameda
Pacific Shops, Inc., and Alameda Pacific Shops, Inc., has indicated
their desire to accept such assignment; and
WHEREAS, it is in the best interests of the City of Alameda
that such consent be given;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
ALAMEDA that said City does hereby consent to and approve the assign-
ment of that certain assignment of lease dated November 14, 1974,
by and between the City of Alameda, Lessor, and John Bentzen, Lessee,
said assignment being from John Bentzen to Alameda Pacific Shops,
Inc.
BE IT FURTHER RESOLVED that the Mayor of the City of
Alameda be, and she is hereby, authorized to execute, for and on
behalf of the City, the written consent of the City to the assignment
of said Lease as set out above. The City Clerk is hereby directed
to attest to same.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 21st of February, 1984,
by the following vote to wit:
AYES: Councilmembers Gorman, Hanna, Lucas and President Diament - 4.
NOES: None.
ABSENT: Councilmember Monsef - 1.
