Resolution 10263CITY OF ALAMEDA RESOLUTION NO. 10263 AUTHORIZING EXECUTION OF AGREEMENT WITH THE AEOLIAN YACHT CLUB AND THE SAN FRANCISCO BAY CONSERVATION AND DEVELOPMENT COMMISSION TO PROVIDE CERTAIN PUBLIC ACCESS WHEREAS, the San Francisco Bay Conservation and Development Commission (BCDC), in its approval of the construction of Fernside Boulevard in the vicinity of the Aeolian Yacht Club, required various conditions regarding public access to the shoreline; and WHEREAS, a form of agreement between BCDC, the Aeolian Yacht Club and the City containing the conditions, covenants and restrictions to be entered into is on file in the office of the City Clerk and the Council is informed of the contents thereof; and WHEREAS, it is in the public interest that said Agreement be entered into; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL CF THE CITY OF ALAMEDA that the agreement referred to ahove, and the conditions, covenants and restrictions contained therein be, and the same are hereby approved. BE IT FURTHER RESOLVED that the City Manager be, and he is hereby authorized to execute, for and on behalf of the City of Alameda, that certain proposed agreement with the Aeolian Yacht Club and BCDC imposing restrictions on the use of real property to provide public access, and the City Clerk is hereby authorized and directed to attest to same. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 6th of March, 1984 by the following vote to wit: AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and President Diament - 5.
