ORDERING VACATION OF CERTAIN UNUSED POWER EASEMENTS
WITHIN BLOCKS 10 AND 11 OF TRACT 3841 AND ACCEPTING
A GRANT OF POWER EASEMENTS FROM SANDPIPER COVE ASSOCIATES
WHEREAS, Sandpiper Cove Associates, a joint venture,
consisting of Hermes Financial Corporation, a California corporation,
and Coventry West Homes, Inc., a California corporation, has
requested revised power transformer locations within Blocks 10
and 11 of Tract 3841; and
WHEREAS, to accomplish said changes it is necessary to
vacate the existing easements and accept replacement easements;
and
WHEREAS, a certain Grant of Easements dated June 22, 1984,
granted by Sandpiper Cove Associates to the City of Alameda for
easements and rights-of-way for electric power purposes, fully
described herein and in said Grant of Easement, has been executed
and delivered by the Grantor to the City; and
WHEREAS, it is in the best interets of the City that said
easements be vacated and accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the certain power easements in Lot 4, Block 10
and in Lots 18 and 19 in Block 11, Tract 3841, Alameda, California,
and described as follows:
PARCEL 1. The strip of land designated as "6 X
6' P.E." lying in Lots 18 and 19 in Block 11 as shown
upon that certain map entitled, "TRACT 3841, ALAMEDA,
CALIFORNIA" filed February 27, 1979 in Book 108 of Maps
at pages 68 thru 76, inclusive, County of Alameda Records.
PARCEL 2. The strip of land designated as "Parcel
'J', Power Easement" in that certain Grant of Easement
filed July 29, 1979 in the Recorder's Series No 79-143678
of the Official Records of the County of Alameda, California,
said strip of land being in the northwesterly portion
of Lot 4 in Block 10 of that certain map entitled, "TRACT
3841, ALAMEDA, CALIFORNIA" filed February 27, 1979 in
Book 108 of Maps at pages 68 thru 76, inclusive, County
of Alameda Records.
are hereby ordered vacated pursuant to the provisions of Chapter
4, part 3, Division 9 of the California Streets and Highways
Code, and particularly Section 8333 thereof.
BE IT FURTHER RESOLVED that the Council of the City of
Alameda hereby finds and declares that (1) the said easements
ordered vacated herein are unnecessary for present or prospective
public use, and (2) that said easements have never been used
by the City of Alameda for any purpose whatever since the date
of their acquisition to the date of this resolution.
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this order, attested under seal, to be
recorded in the County Recorder's Office and from and after the
date this resolution is recorded the power easements vacated
no longer shall constitute public service easements.
BE IT FURTHE RESOLVED that the aforementioned Grant of
Easements dated June 22, 1984, granted by Sandpiper Cove Associates,
a joint venture, consisting of Hermes Financial Corporation,
a California corporation and Coventry West Homes, Inc., a
California corporation, to the City of Alameda for permanent
easements and rights-of-way for electric power purposes within
Lot 5 in Block 10 and Lot 18 in Block 11 of Tract 3841 and
described as follows:
PARCEL "A". A 10-foot by 10-foot square parcel of
land in the northwesterly portion and abutting the westerly
and northerly lines of Lot 5 in Block 10 hereinabove referred
to.
PARCEL "B". A parcel of land in the northwesterly
portion of Lot 18 in Block 11 hereinabove referred to
and being more particularly described as follows:
BEGINNING at the northwesterly corner of said Lot 18;
THENCE along the northerly line of said Lot 18, N.80045'10"
E. 10.00 feet;
THENCE S.09°14'50" E. 10.00 feet;
THENCE S.80°45'10" W. to the point of intersection thereof
with the westerly line of said Lot 18;
THENCE northerly along last said line to the POINT OF
BEGINNING.
is hereby accepted on behalf of the City of Alameda and said
Council, acting for and on behalf of said City, hereby consents
to the recordation of said Grant of Easements and orders this
resolution to be attached thereto, as required by Section 27281
of the Government Code of the State of California.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 7th of August, 1984,
