CITY OF ALAMEDA RESOLUTION NO. 10429
AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION
AND COMPLETION OF IMPROVEMENTS IN CONNECTION WITH
SUBDIVISIONS 5221, 5222 AND 5223 AND APPROVING BONDS
AS TO SUFFICIENCY (BRITTANY LANDING, PONDEROSA HOMES,
SUBDIVIDER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI
of the Alameda Municipal Code, Ponderosa Homes, a California
general partnership, owner and subdivider herein, has prepared
and presented to this Council the Final Maps of the subdivisions
known as Tracts 5221, 5222 and 5223; and
WHEREAS, subdivider has entered into an agreement to
construct and complete the improvements in said subdivisions,
has filed the Final Maps thereof for approval at this time,
and has posted its bonds guaranteeing full and faithful performance
of said work, all in accordance with said Article; and
WHEREAS, it will be to the advantage and benefit of
the City to have said work performed in accordance with said
agreement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the agreement for construction and completion
of the public improvements in said subdivisions, and all its
terms and conditions be, and hereby is, approved and the City
Manager and the City Clerk are authorized and directed to execute
and attest to, respectively, said agreement on behalf of the
City of Alameda.
BE IT FURTHER RESOLVED that the bonds in the sum of
$1,216,000, guaranteeing full and faithful performance of the
subdivider's said public improvements construction contract,
are hereby approved as sufficient in amount.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly-adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 4th of September, 1984,
by the following vote to wit:
AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
IN WETNESS WHEREOF, L have hereunto set my hand and affixed the
