Resolution 10497ORi G1NA..L RESOLUTION NO. 10497 JHHW:SRC:cmf 10/23/84 1249S A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE MAKING OF ACQUISITIONS AND IMPROVEMENTS WITHOUT FURTHER PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE HARBOR BAY BUSINESS PARK ASSESSMENT DISTRICT 84 -4 RESOLVED, by the City Council of the City of Alameda, County of Alameda, California, that WHEREAS, a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the cost thereof upon the properties benefited, and waiving proceedings under Division 4 of the Streets and Highways Code, signed by the owners of more than 60% in area of the properties proposed to be assessed, has been filed with the City Clerk for the making of the acquisitions and improvements described on Exhibit "A" attached hereto and made a part hereof; WHEREAS, the costs and expenses of said acquisitions and improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area shown on the map thereof on file in the office of said Clerk, to which reference is hereby made for further particulars; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED as follows: 1. That all of the owners of more than 60% in area of the property subject to assessment for said acquisitions and improvements who appear to be such on the Assessor's roll on the day that said petition was filed, or, in the case of transfers of land or parts thereof subsequent to the date upon which the last Assessor's roll was prepared, appear to be such on the records in the County Assessor's office which the County Assessor will use to prepare the next ensuing Assessor's roll, have signed and filed with said Clerk a written petition for said acquisitions and improvements and a written waiver of investigation proceedings under Division 4 of the Streets and Highways Code. 2. That the provisions of Division 4 of the Streets and Highways Code, other than those which relate to the foregoing findings, determinations and orders, shall not apply to the making of said acquisitions and improvements, and proceedings therefor shall be had pursuant to the Municipal Improvement Act of 1913 and bonds shall be issued pursuant to the Improvement Bond Act of 1915, without further proceedings under said Division 4. * * * * * * * * * * * * * ** 2 JHHW:SRC:cmf 11/15/84 1263S Harbor Bay Business Park Assessment District 84 -4 Within the City of Alameda, Alameda County, California, the following improvements according to the applicable standards of the City of Alameda , the Department of Electricity of the City of Alameda and any appropriate public agency or regulated public utility which may own, operate or maintain any or all of said improvements (all measurements are approximate and all Assessor's Parcel Numbers are denoted "APN "): 1. The construction of streets, including, as appropriate, realignment of rights of way, clearing, grubbing, grading and the installation of base, pavement, curbs, gutters, sidewalks, underground electric and telecommunication facilities, gas, water and sanitary sewer lines and storm drainage facilities including related and appropriate substructures, valves, fire hydrants, meters, blow -offs, manholes, catch basins, laterals, stubs and fittings, street lighting facilities including electroliers and luminaires, conduits and substructures for trafic signals and street striping and signs, as follows: a. The extension of Harbor Bay Parkway from approximately its present point of termination, westerly and northwesterly a distance approximately of 5400 feet with pavement width of 64 feet, curb to curb together with required medians, intersections, left turn lanes and related features; b. South Loop Road commencing on the south side of existing Harbor Bay Parkway at its intersection with existing "B" Street and thence southerly, southwesterly and northerly to an intersection with the extension of Harbor Bay Parkway shown in 1.a. above at a point on Harbor Bay Parkway 1650 feet from the point of commencement, a distance of approximately 3000 feet with pavement width of 40 feet, curb to curb; 2. The acquisition of the completed west side of "A" Street commencing on the northern side of existing Harbor Bay Parkway and extending northeasterly 700 feet with 20 feet of pavement, curb, gutter, sidewalks and all utilities installed therein; 3. The construction of storm drainage facilities, other than those contained in the above steets, including required trenching, backfilling and compaction, as follows: a. A 36 -42 inch storm drainage line commencing at a point on the northern boundary of APN 74- 1040 -16 approximately 700 feet westerly of the easternmost corner of APN 74- 1040 -15, and extending westerly and southwesterly to Harbor Bay Parkway as shown in 1.a. above, a distance of approximately 1450 feet; Exhibit "A" (i) b. A 60 inch storm drain commencing at the end of existing Storm Drain "B" located on the southeasterly line of APN 74- 1040 -16 and extending therefrom southeasterly along said line to a discharge point near the the southeasternmost corner of said APN, a distance of 1650 feet; c. A 48 inch storm drain commencing at a point on South Loop Road as shown in 1.b. above approximately 600 feet south of the western intersection of said road and Harbor Bay Parkway and extending 800 feet southeasterly to intercept the storm drain shown in 3..b. above; d. A 42 inch storm drain outfall 200 feet in length located on the southerly line of APN 74- 1040 -16, approximately 1000 feet west of the southernmost corner of said APN; e. A 36 inch storm drain by pass commencing in Harbor Bay Parkway as shown in 1. a. above at a point 1000 feet westerly of the western intersection of Harbor Bay Parkway and South Loop Road and extending therefrom southwesterly 200 feet to a discharge point on the Port of Oakland Lagoon located 2800 feet westerly of the southernmost corner of APN 74- 1040 -16; 4. The constuction of landscaping, including, as required, trees, shrubs, groundcover, lawn, irrigation systems with related valves, controllers and emitters, and decorative entry features including related paving, lighting and ornamental features, as follows: a. Along the streets shown in 1. a and 1. b. above; b. In such other locations as may approved on plans reviewed by the City of Alameda; 5. The construction of lake landscaping features commencing on the easterly side of the easterly intersection of said Harbor Bay Parkway and South Loop Road and extending westerly along the southern side of Harbor Bay Parkway to the western side of the western instersection of said Parkway and said Road, consisting of 6 acres with plantings, curb walls, required circulation facilities and appurtenances; 6. The construction of modifications to existing Bridgeway Sewer Pump Station including new pumping equipment, controlls and fittings as required; 7. The construction of a public dock facility located at a point 1250 feet northwest of the Port of Oakland levy on the southwestern boundary of APN 74- 1040 -16, including all required dredging and the installation of pilings, breakwaters, wharves, piers, gangways, docking facilities, and public access facilities including required entry features and related public parking and landscaping; 8. The filling of exsiting drainage ditches as required in and around APN 74- 1040 -16 by removal of existing vegetation, grading, and the installation of engineered fill material; and Exhibit "A" (ii) 9. The acquisition of all rights of way, franchises, permits and licenses, rights of service and use, approved plans, specifications and drawings and the construction of all auxiliary work necessary and /or convenient for the accomplishment of the foregoing improvements. Exhibit "A" (iii) I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th of December, 1984, by the following vote to wit: AYES: Councilmembers Gorman, Hanna, Lucas, Monsef and President Diament - NOES: None.
