AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION
AND COMPLETION OF IMPROVEMENTS IN CONNECTION WITH
SUBDIVISION TRACT 4276 AND APPROVING BONDS AS TO
SUFFICIENCY (WHALERS COVE, GREAT SIERRA GROUP, INC.,
SUBDIVIDER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI
of the Alameda Municipal Code, Ballena Bay Townhouse Partnership,
a Limited Partnership, by Great Sierra Group, Inc., a California.
Corporation, a general partner, subdivider herein, has prepared
and presented to this Council the Final Map of the subdivision
known as Tract 4276; and
WHEREAS, said Subdivider has entered into an agreement
to construct and complete the improvements in said subdivision,
has filed the Final Map thereof for approval at this time,
and has posted an Original Note and Deed of Trust on the
property located at Tideway Drive in the City of Alameda
guaranteeing full and faithful performance of said work, all
in accordance with said Article; and
WHEREAS, it will be to the advantage and benefit of
the City to have said work performed in accordance with said
agreement;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the agreement for construction and
completion of the public improvements in said subdivision,
and all its terms and conditions be, and hereby is approved,
and the City Manager and the City Clerk are authorized and
directed to execute and attest to, respectively, said agreement
on behalf of the City of Alameda.
BE IT FURTHER RESOLVED that the Note and Deed of Trust,
in the amount of $231,000, guaranteeing full and faithful
performance of the subdivider's said public improvements
construction contract, is hereby approved as sufficient in
amount.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 19th of March, 1985,
by the following vote to wit:
AYES: Councilmembers Gorman, Lucas, Monsef and Acting President Hanna - 4.
NOES: None.
ABSENT: President Diament - 1.
IN WITNESS WHEREOF, I have hereunto set my hand and affixed the
