AUTHORIZING EXECUTION OF AGREEMENT WITH PORT OF
OAKLAND FOR MAINTENANCE OF HARBOR BAY PARKWAY FROM
DOOLITTLE DRIVE TO THE NORTHERN BOUNDARY OF THE
HARBOR BAY BUSINESS PARK
WHEREAS, Island City Landscaping and Lighting District 84-2
was formed for the purpose of providing funds for the maintenance
of certain street and other public improvements within the City of
Alameda; and
WHEREAS, Zone 5 has been annexed to said Assessment District
and includes a portion of Harbor Bay Parkway; and
WHEREAS, the Port of Oakland has agreed to contribute to
the maintenance of the off-site portion of Harbor Bay Parkway; and
WHEREAS, a form of Maintenance Agreement between the City of
Alameda and the City of Oakland, acting by and through its Board
of Port Commissioners, has been presented to the Council and the
Council is fully informed and aware of the terms and conditions
thereof; and
WHEREAS, it is in the best interests of the City of Alameda
that said agreement be entered into;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the City Manager is hereby authorized and directed
to execute, for and on behalf of the City, that certain agreement
referred to above by and between the Port of Oakland and the City
of Alameda, for maintenance of Harbor Bay Parkway from Doolittle
Drive to the northern boundary of the Harbor Bay Business Park.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 18th of June,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas and Acting President Monsef - 4.
NOES: None.
ABSENT: President Diament - 1.
