AUTHORIZING EXECUTION OF MUTUAL RELEASE CANCELLING
AGREEMENT WITH GOLDEN BEAR LEASING INC. FOR PROVISION
OF GOLF CARTS ON THE ALAMEDA MUNICIPAL GOLF COURSES
WHEREAS, the City is a party to an Agreement date February
15, 1983, under which Golden Bear Equipment Vehicles, Inc., doing
business as Golden Bear Equipment Co., provides golf carts for
use on a rental basis at the Alameda Municipal Golf Courses; and
WHEREAS, it is in the best interests of all parties that
California Golf Centers, Inc., the Golf Professional, maintain the
golf carts; and
WHEREAS, a separate agreement has been entered into whereby
California Golf Centers, Inc. acquired Golden Bear's interest
in the February 15, 1983 agreement for provision of golf carts
at the City's courses; and
WHEREAS, a proposed Mutual Release between the City and
Golden Bear has been submitted to the Council and the City is
informed and aware of the contents of said Release;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Alameda that the Mayor and the City Clerk be, and each
hereby is, authorized and directed to execute and attest to,
respectively, on behalf of the City, that certain Mutual Release
between the City and Golden Bear Equipment Co. to completely
terminate all rights, duties, obligations, liabilities, or
responsibilities that either party has to the other under the.
Agreement entered into on February 15, 1983, by said parties.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 18th of June, 1985,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas and Acting President Monsef - 4.
NOES: None.
ABSENT: President Diament - 1.
