Resolution 10766RESOLUTION NO. 10766 OF THE COUNCIL OF THE CITY OF ALAMEDA Appointing An Election Board for ) ) Bay Farm Island Reclamation ) ) District No. 2105, General ) ) ) ) ) Election, November 5, 1985 WHEREAS, a general election to elect three (3) persons as Trustees of Bay Farm Island Reclamation District No. 2105 has been noticed for November 5, 1985; WHEREAS, the Secretary of the Board of Trustees of Bay Farm Island Reclamation District No. 2105 has requested that the Council of the City of Alameda appoint an election board pursuant to law to supervise said election; WHEREAS, Section 50700 authorizes the Council of the City of Alameda to appoint an election board consisting of three (3) landowners, or legal representatives of landowners, of Bay Farm Island Reclamation District No. 2105; and WHEREAS, said statute provides that the election board shall consist of one (1) inspector and two (2) judges of election; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda, as follows: Section 1. Pursuant to Section 50700 of the Water Code of the State of California, Charles J. McNeil is hereby appointed to act as inspector of the general election to be held on November 5, 1985, for the election of Trustees of Bay Farm Island Reclamation District No. 2105. Section 2. Pursuant to Section 50700 of the Water Code of the State of California, Joyce Harris is hereby appointed to act as a judge of election for the general election to be held on November 5, 1985, for the election of Trustees of Bay Farm Island Reclamation District No. 2105. Section 3. Pursuant to Section 50700 of the Water Code of the State of California, Robert Adams is hereby appointed to act as a judge of election for the general election to be held on November 5, 1985, for the election of Trustees of Bay Farm Island Reclamation District No. 2105. Section 4. The election board hereby appointed is authorized and instructed to perform the following acts with respect to the general election to be held on November 5, 1985, for the election of Trustees of Bay Farm Island. Reclamation District No. 2105: Determine the number of votes each eligible voter may cast in said election, and the voting power of each such voter, in the manner provided in Sections -2- 50702, 50704 and 50704.5 of the Water Code of the State of California; (b) Establish a procedure for accepting proxy votes in said general election, said procedure to include at a minimum the following: (i) That any person entitled to vote in said District election may execute and file a written proxy authorizing another to exercise his/her/its voting rights; That to render valid any proxy so made, the signature of the maker of the proxy must appear at the bottom of the proxy in the same manner as that voters name appears on the property records maintained by the Alameda County Recorder and said signature must be acknowledged as required by law; (iii) That to render valid any proxy so made, all owners of the property creating the voting power in the maker of the proxy must sign the proxy in the same manner as each such owner's name appears in the property records maintained by the Alameda County Recorder and each such signature must be acknowledged as required by law; (iv) That each proxy so made shall be valid for this District election only; (v) That any proxy so made may be revoked only by way of a writing signed by the voter making the proxy in the same manner as that voter's name appears on the property records maintained by the Alameda County Recorder and acknowledged in the same manner in which proxies are required to be acknowledged; (vi) That the proxy so made must be filed with the election board hereby appointed by no later than the time when the proxy holder appears at the polling place to vote; (vii) That in the event of any conflicting proxies, the proxy bearing the earliest execution date has priority over any subsequent proxy, unless a subsequent proxy expressly revokes the prior proxy; and (viii) That no proxy vote will be accepted, counted or tabulated unless each of the above requirements is fully met. (c) Develop and provide to the eligible voters in the District election an official form of proxy to be used in the District election, and provide public notice of the proxy procedure and the availability of the proxy forms, and further provide notice that no proxy will be accepted unless it is made on the prescribed official form and in the manner established by the election board. (d) Determine the validity of any challenges and questions in any way arising in connection with the voting in the District election. (e) Receive, count and tabulate all votes cast -4- in the District election. (f) Close the polls at the time designated by the Secretary of the Board of Trustees of Bay Farm Island Reclamation District No. 2105. (g) Canvass the votes cast, determine the results of the election, issue certificates of election to the persons elected, and place the ballots, when canvassed, in a sealed envelope and forward it to the Clerk of the City Council of the City of Alameda, in accordance with Section 50752 of the Water Code of the State of California. (h) Generally supervise and maintain the fairness of the District election. Section 5. The election board hereby appointed, and each member thereof, shall swear an oath, administered by the City Clerk, to faithfully perform their duties as an election board members. Section 6. The decision, act or certificate of a majority of the members of the election board is effective in all respects as the decision, act or certificate of the board, and any report or certificate made by the election board is prima facie evidence of the facts stated therein.
