Resolution 10774CITY OF ALAMEDA RESOLUTION NO. 10774 ESTABLISHING UNDERGROUND UTILITY DISTRICT #1, OTIS DRIVE BETWEEN HIGH STREET AND THE BAY FARM ISLAND BRIDGE, PURSUANT TO ORDINANCE NO. 2212 N.S. WHEREAS, at its meeting of October 1, 1985, this Council set a public hearing for November 5, 1985, at the hour of 7:30 p.m. in the Council Chambers in the City Hall, Alameda, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated services within Underground Utility District #1 comprising the area hereinafter described: Otis Drive from the east side of Post Street to the north end of the Bay Farm Island Bridge Structure. All of Bridgeview Isle. Peach Street from Otis Drive to Bridgeview Drive. WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the matter and for the time required by law, and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that said Council hereby finds that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication and similar or associated services; and further finds that the streets, roads or right of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic and hereby declares that the above described area is established as Underground Utility District #1; and BE IT FURTHER RESOLVED that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: 1. Underground installations by utility companies and property owners and reconnections not later than 12 months after the date of passage of this resolution by the City Council. 2. Removal of poles, overhead wires and other associated overhead structures not later than 16 months after the date of passage of this resolution by the City Council; and BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to mail, within ten (10) days after the adoption of this resolution, a copy hereof and a copy of Ordinance No. 2212 N.S. to affected property owners as such as shown on the last equalized roll and to the affected utilities. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 5th of November, 1985, by the following vote to wit: AYES: Councilmembers Lucas, Monsef and President Diament - 3.
