Resolution 107790 CITY OF ALAMEDA RESOLUTION NO. 10779 ORDERING VACATION OF A PUBLIC UTILITY EASEMENT IN LOTS 73 AND 81 OF TRACT 4402 (HARBOR BAY ISLE LANTERN BAY) BE IT RESOLVED by the Council of the City of Alameda that the certain Public Utility Easement located with Lots 73 and 81 of Tract 4402 (Harbor Bay Isle Lantern Bay) granted to the City on June 20, 1984 and more particularly described as: Those certain adjacent strips of land, 5.00 feet in width designated collectively as 10° x 10' Public Utility Easement (P.U.E.) lying in Lots 73 & 81 as said easements and lots are shown upon that certain map entitled, "TRACT 4402, ALAMEDA, CALIFORNIA", recorded June 20, 1984 in Book 145 of Maps at Pages 27-33, Official Records of Alameda County. is hereby ordered vacated pursuant to the provisions of Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8333 thereof. BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (1) the said easement ordered vacated herein is unnecessary for present or prospective public use, and (2) that said easement has never been used by the City of Alameda for any purpose whatever since the date of its acquisition to the date of this resolution. BE IT FURTHER RESOLVED that the City Clerk shall cause a certified copy of this order, attested under seal, to be recorded in the County Recorder's Office and from and after the date this resolution is recorded the public utility easement vacated no longer shall constitute a public utility easement. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 19th of November, 1985, by the following vote to wit: AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
