AUTHORIZING AMENDMENT TO JOINT EXERCISE OF POWERS
AGREEMENT FOR CONTROL OF WET WEATHER OVERFLOWS
AND BYPASSES BETWEEN THE CITY OF ALAMEDA AND THE
EAST BAY MUNICIPAL DISTRICT
WHEREAS, on February 13, 1979, the City of Alameda and
six other owners and operators of community sewer systems entered
into a Joint Powers Agreement with the East Bay Municipal Utility
District (EBMUD) to conduct a study for the control of wet
weather overflows and bypasses; and
WHEREAS, an amendment to said agreement is required to
to allow the Joint Powers to apply for and administer grants and
to provide mutually-agreed joint efforts to carry out
implementation of the study recommendations; and
WHEREAS, it will be in the best interests of the City
that the Joint Powers Agreement be amended as proposed;
'4 4 NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that the Mayor and City Clerk be, and each hereby is,
authorized to execute and to attest to respectively, on behalf
a: of the City, an amendment to the Joint Powers Agreement with
EBMUD.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 3rd of December, 1985,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament -
NOES: None.
ABSENT: None.
