Resolution 10830CITY OF ALAMEDA RESOLUTION NO. 10830 DESIGNATING EAST BAY MUNICIPAL UTILITY DISTRICT AS LEAD AGENCY FOR ENVIRONMENTAL DOCUMENTATION FOR INFILTRATION /INFLOW CORRECTION WHEREAS, in March 1975 a report entitled Control of Wet Weather Overflows and Bypasses was completed by the East Bay Municipal Utility District, with the cooperation of the seven communities comprising EBMUD Special District No 1; and said report identified problems and recommended further studies to control wet weather flows in the East Bay Area; and WHEREAS, in September 1975 the California Regional Water Quality Control Board (RWQCB) issued a National Pollution Dischasrge Elimination System (NPDES) permit to the City of Alameda which required elimination of all overflows from its collection system; and similar NPDES permits and requirements were issued to other communities within the EBMUD service area; and the RWQCB issued an NPDES permit to the EBMUD prohibiting overflows from the District interceptor system and Wastewater Treatment Plant and issuing requirements to control overflows and bypasses; and WHEREAS, in 1979 the City of Alameda and the other six communities owning and operating collection sewer systems in the East Bay entered a Joint Powers Agreement with the East Bay Municipal Utility District as Lead Agency, to conduct an Infiltration /Inflow Study; and the Study was to develop a Sewer System Evaluation and recommend a plan of action for the elimination of I/I overflows in each community; and WHEREAS, the Draft East Bay I/I Study Report was completed and filed with each participating community in April, 1985,; and after review, public participation and comments, the elements of the final I/I Study Report were filed with each participating community in September, 1985; and the I/I Study Report recommends a 20 -year I/I correction program for the City of Alameda to include projects for sewer system rehabilitation and capacity improvements as approved by City from time to time; and WHEREAS, a Compliance Plan has been developed for the City of Alameda to implement the commendations of the I/I Final Study Report for a 20 -year I/I correction program and the City of Alameda wishes to accept the program element of the Study Report and commence implementation of the first five -year phase I/I Correction Projects; and WHEREAS, the participating communities and EBMUD have executed an amendment to the Joint Powers Agreement to provide that EBMUD will serve as Lead Agency for the first five-year phase implementation of the I/I Correction Projects of communities; and the City of Alameda desires to have EBMUD serve as Lead Agency for the preparation of a program EIR in accordance with CEQA for the I/I Correction Program of the City of Alameda and EBMUD has prepared a Draft EIR for said correction projects. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that the City of Alameda does hereby approve the element of the East Bay I/I Final Study Report (and the SSES) for the City of Alameda and declares its intention to implement the first five-year phase I/I Correction Projects recommended in said study. BE IT FURTHER RESOLVED that the City of Alameda does hereby designate the EBMUD as Lead Agency for the preparation of a program EIR for the I/I Correction Project of the City of Alameda and the City of Alameda does hereby endorse and approve the draft EIR prepared by EBMUD. EL- I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th of February, 1986, by the following vote to wit: AYES: Councilmembers Corica, Hanna, Lucas and President Diament - 4.
