Resolution 11057CITY OF ALAMEDA RESOLUTION NO.11057 A RESOLUTION APPROVING PROJECT AND BONDS FOR PARK STREET LANDING, A CALIFORNIA LIMITED PARTNERSHIP PARK STREET LANDING PROJECT RESOLVED, by the City Council of the City of Alameda, California, that WHEREAS, a copy of an Application by Park Street Landing, a California limited partnership, or a related person (the "Participating Party"), has been filed with the City Clerk and on the basis thereof, the City Council adopted its Resolution No 10999, entitled "A Resolution of Acceptance of Application For Financing and of Determination and of Intention to Undertake Project and to Issue Bonds Therefor, and Approving and Authorizing a Preliminary Agreement Between the Participating Party and the City With Reference to Such Financing", which among other things provided a form of notice and for the setting of a public hearing and publication of the notice by the City Clerk; and WHEREAS, the notice, entitled "Notice of Public Hearing" (the "Notice"), has been published once, not less than 14 days prior to the time of the hearing referred to therein, in The Alameda Times Star, a newspaper of general circulation available to residents of the City of Alameda, a copy of which Notice is attached hereto, and the matter has come on regularly for hearing by the City Council; NOW, THEREFORE, IT IS DETERMINED AND ORDERED as follows: 1. A public hearing, providing a reasonable opportunity for interested individuals to express their views, both orally and in writing, on the proposed revenue bond financing and the location and nature of the Facilities has been conducted by this Council on public notice reasonably designed to inform residents of the City of Alameda of the proposed financing. 2. The Notice attached hereto, including the description of the Facilities, the initial owner, operator or manager of the Facilities and the location thereof, and the Project, including the maximum amount of Bonds proposed to be issued as a part thereof, is hereby incorporated herein. 3. The Facilities and the Project, inclusive of revenue bond financing, is hereby -unconditionally approved. 4. Notwithstanding paragraph 3, hereof, the Participating Party shall comply with (or cause to be complied with) the Preliminary Agreement entered into by the Participating Party and the City and all other applicable requirements. 5.
