AUTHORIZING FILING APPLICATION FOR FEDERAL AND STATE
GRANTS FOR SEWER REHABILITATION WORK, AUTHORIZING
ACCEPTANCE AND PROVIDING CERTAIN ASSURANCES
BE IT RESOLVED by the Council of the City of Alameda that
the East Bay Municipal Utility District Manager of Wastewater is
hereby authorized and directed to sign and file, for and on
behalf of the City of Alameda, an Application for Federal
Assistance under the Federal Water Pollution Control Act, as
amended (33 U.S.C. 1251 et seq.) and any agreements or other
documents necessary to secure and receive a grant under said act
and a state grant under the Clean Water Bond Laws of 1970 and
1974 and the Clean Water and Water Conservation Bond Law of 1978
for construction of wastewater treatment works.
BE IT FURTHER RESOLVED that the City of Alameda hereby
agrees and further does authorize the aforementioned
representative to certify that it has and will comply with all
applicable state and federal statutory and regulatory
requirements related to any federal or state grant received,
including but not limited to the Assurances contained in the
Federal Grant Application and the State Grant Contract, The
Freedom of Information Act, 5 U.S.C. 552 as amended relating to
the right of the public to obtain information and records, The
National Historic Preservation Act of 1966, U.S.C. 470 et seq., as
amended, relating to the preservation of historic landmarks, The
Copeland (Anti- Kickback) Act, 18 U.S.C. 874, 40 U.S.C. 276c and
the regulations issued thereunder, 29 CFR 3.1 et seq., and The
Contract Work Hours and Safety Standards Act, 40 U.S.C. 327 et
seq., and the regulations issued thereunder.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 3rd of February, 1987,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas and
President Diament - 4.
NOES: None.
ABSENT: Vice Mayor Monsef -
