ORDERING VACATION OF A PUBLIC UTILITY EASEMENT
IN TRACT 4513 (HARBOR BAY ISLE, WOODBRIDGE
ESTATES)
BE IT RESOLVED by the Council of the City of Alameda that
the certain Public Utility Easement located within Lots 12 and 39
of Tract 4513, granted to the City of Alameda on January 27,
1981, and more particularly described as
Those certain adjacent strips of land, 5.00 feet
in width designated collectively as 10' x 10° Public
Utility Easement (P.U.E.) lying in Lots 12 and 39
as said easements and lots are shown upon that
certain map entitled, "TRACT 4513, ALAMEDA,
CALIFORNIA," recorded January 27, 1981 in Book 123
of Maps at pages 60 -63, Official Records of Alameda
County.
is hereby ordered vacated pursuant to the provisions of Chapter
4, Part 3, Division 9 of the California Streets and Highways
Code, and particularly Section 8333 thereof.
BE IT FURTHER RESOLVED that the Council of the City
of Alameda hereby finds and declares that (1) the said easement
ordered vacated herein is unnecessary for present or prospective
public use, and (2) that said easement has never been used by the
City of Alameda for any purpose whatever since the date of its
acquisition to the date of this resolution.
BE IT FURTHER RESOLVED that the City Clerk shall cause a
certified copy of this order, attested under seal, to be recorded
in the County Recorder's Office and from and after the date this
resolution is recorded the public utility easement vacated no
longer shall constitute a public utility easement.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by
the Council of the City of Alameda in regular meeting
assembled on the 3rd of March, 1987,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas and
President Diament - 4.
NOES: None.
ABSENT: Vice Mayor Monsef - 1.
