CONSENT OF ASSIGNMENT OF LEASE TO ENCINAL MARINA,
INC. OF CERTAIN REAL PROPERTY HELD UNDER LEASE BY
AND BETWEEN THE CITY OF ALAMEDA AND ENCINAL INDUSTRIES,
INC. (TIDELANDS EAST OF FORTMAN MARINA AND NORTH OF
FORTMANN WAY)
WHEREAS, on the 6th day of January, 1984, an Amended and
Restated Lease of certain real property owned by the City of
Alameda was entered into by and between the City of Alameda,
as Lessor, and Encinal Industries, Inc., as Lessee; and
WHEREAS, said lease requires that the written consent
of the Lessor be first had and obtained prior to the assignment
of any portion of said lease to a third party; and
WHEREAS, Encinal Industries, Inc. has requested that the
City of Alameda consent to the assignment of the following
parcels:

of said lease to Encinal Marina, Ltd., a California Limited
Partnership, and Encinal Marina, Ltd. has indicated its desire
to accept such assignment; and
WHEREAS, it is in the best interests of the City of
Alameda that such consent be given;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that said City does hereby consent to and approve
the assignment of Parcels No. 23, 24, 25, 26, 27 and 28 of that
certain Amended and Restated Lease dated January 6, 1984, by and
between the City of Alameda, Lessor, and Encinal Industries,
Inc., Lessee, said assignment being from Encinal Industries,
Inc. to Encinal Marina, Ltd.
BE IT FURTHER RESOLVED that the Mayor of the City of
Alameda be, and she is hereby, authorized to execute, for and
on behalf of the City, the written consent of the City to the
assignment of Parcels No. 23, 24, 25, 26, 27 and 28 of said
Amended and Restated Lease as set out above. The City Clerk
is hereby directed to attest to same.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 7th of April, 1987,
by the following vote to wit:
AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
NOES: None.
ABSENT: None.
