Resolution 11178CITY OF ALAMEDA RESOLUTION NO. 11178 DECLARING CANVASS OF RETURNS AND RESULTS OF GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, APRIL 21, 1987 WHEREAS, a General Municipal Election consolidated with a Special Municipal Charter Amendment Election and a Governing Board Member Election of the Peralta Community College District of Alameda County was held in the City of Alameda on April 21, 1987, under and pursuant to the provisions of Article XIX of the Charter of said City, for the purpose of electing officers to the offices of Mayor, Councilmember, Member of the Board of Education, and for the further purpose of submitting to the qualified electors of said City amendments to the Charter of the City of Alameda and a "Traffic Management Initiative Ordinance", as set forth hereinafter: One (1) Mayor of said City for a full term commencing at 8:00 o'clock p.m. on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified. Two (2) Councilmembers on the Council of said City for two full terms, each term commencing at 8:00 o'clock p.m. on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified. Two (2) members on the Board of Education of said City, each term commencing at 8:00 o'clock p.m. on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified. MEASURE A Shall the Charter of the City of Alameda be amended to remove the requirement that ordinances may only be passed at regular or adjourned regular meetings? Said amendment will be accomplished by amending Section 3-11 of said Charter, all as fully set forth in Resolution No. 11086 of the Council of the City of Alameda. MEASURE B Shall the Charter of the City of Alameda be amended to provide for reduction in membership of the Social Service Human Relations Board from nine members to seven? Said amendment will be accomplished by amending Section 10-4 of said Charter, all as fully set forth in Resolution No. 11086 of the Council of the City of Alameda. -1- MEASURE C Shall the "Traffic Management Initiative Ordinance" be adopted amending sections of the Combined Land Use Plan of the City of Alameda to require prior to the approval of any large land use entitlement that all signalized or other major intersections impacted by the proposed use be operating at Service Level C, defined as an average twenty-five seconds or less delay during the fifteen minute daily commute hour peak period, all as fully set out in Resolution No. 11088 of the Council of the City of Alameda? WHEREAS, nominating petitions were duly and regularly presented to, and filed in the office of the City Clerk of the City of Alameda, in the time, form and manner prescribed by law, nominating for said offices: FOR THE OFFICE OF MAYOR: Chuck Corica Richard D. Armstrong Anne Teunis FOR THE OFFICE OF MEMBER, BOARD OF EDUCATION: Gig Edward Codiga Samuel J. Huie WHEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the time, form and manner prescribed by law, whereupon a notice of Nominees for Public Office containing a statement of the time of the election, the offices to be filled, and the names of the candidates to be voted on, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said city, the last publication thereof being more than five (5) days before the date of said election; and WHEREAS, a Notice of the Proposed Amendments to the Charter of the City of Alameda, certified by the City Clerk, was duly issued and published in the official newspaper of said City in the manner and time prescribed by law; and WHEREAS, a Notice of the Proposed "Traffic Management Initiative Ordinance", certified by the City Clerk, was duly issued and published in the official newspaper of said City in the manner and time prescribed by law; and WHEREAS, there were 53 consolidated election precincts within the City of Alameda fixed and designated by resolution of the Council of said City; and WHEREAS, all of the ballots used for said election were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten (10) days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and WHEREAS, the Council of the City of Alameda, at this, the first Tuesday following said election, has met and fully canvassed the returns of the votes cast at said General Municipal Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as follows: (1) That said General Municipal Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (2) That the whole number of votes cast in the City of Alameda at said election was 14,346. (3) That the total number of votes cast in the City of Alameda at said election for each of the aforesaid candidates for the office of Mayor of said City was as follows: Chuck Corica Richard D. Armstrong 752 Anne Teunis 626 (5) That the total number of votes cast in the City of Alameda at said election for each of the aforesaid candidates for the office of Member of the Board of Education of said City was as follows: Gig Edward Codiga Samuel J. Huie 10,407 9,545 (6) That the total number of votes cast in the City of Alameda at said election for the aforesaid Charter Amendment Measures was as follows: Measure A Measure B Yes: Yes: 6,553 9,904 No: No: 6,530 3,206 (7) That the total number of votes cast in the City of Alameda at said election for the aforesaid "Traffic Management Initiative Ordinance" was as follows: Measure C Yes: 6,452 No: 8,627 NOW, THEREFORE, BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that the aforesaid CHUCK CORICA, having received the highest number of votes cast for the office of Mayor, was, and is hereby declared to be, duly and regularly elected to the office of Mayor of the City of Alameda for a term beginning at 8:00 o'clock p.m., on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified. BE IT FURTHER RESOLVED AND DECLARED that the aforesaid BARBARA THOMAS and JOSEPH A. CAMICIA, having received the two highest number of votes cast for the office of Councilmember, were, and are hereby declared to be, duly and regularly elected to the office of Councilmember of the City of Alameda, each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified; 0 BE IT FURTHER RESOLVED AND DECLARED that the aforesaid GIG EDWARD CODIGA and SAMUEL J. HUIE, having received the two highest number of votes cast for the office of Member of the Board of Education, were, and are hereby declared to be, duly and regularly elected to the office of Member of the Board of Education of the City of Alameda, each for a term beginning at 8 :00 o'clock p.m., on the third Tuesday in May, 1987, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Measure A and Measure B, each having received a majority of the number of "Yes " votes cast, were, and they are hereby declared, passed. BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Measure C, having received a majority of the number of "No" votes cast, was, and is hereby declared, not passed. BE IT FURTHER RESOLVED AND DECLARED that inasmuch as votes were cast in jurisdictions other than the City of Alameda for the Peralta Community College Governing Board Member, election results shall be declared by the Registrar of Voters of the County of Alameda and a copy shall be filed with the City Clerk of the City of Alameda at such time as the canvass of said votes is completed. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in adjourned regular meeting assembled on the 28th of April, 1987, by the following vote to wit: AYES: Councilmembers Corica, Hanna, Lucas, Monsef and President Diament - 5.
