Resolution 11182CITY OF ALAMEDA RESOLUTION NO. 11182 A RESOLUTION ORDERING CHANGES AND MODIFICATIONS Alameda Marina Village Assessment District 84 -3 RESOLVED, by the City Council of the City of Alameda, County of Alameda, California that WHEREAS, this Council has conducted proceedings pursuant to Resolution of Intention No. 10421 adopted August 21, 1984, for the acquisition and construction of certain public improvements more particularly described therein and to which resolution reference is hereby made for further particulars; WHEREAS, there has been filed with the City Clerk of this City a request from the owners of the lands assessed in proceedings had pursuant to said resolution a request that additional public improvements be made and which improvements will be of benefit to the entire scope of public improvements contemplated by said resolution but which improvements were not originally included in the scope of work described in said resolution; WHEREAS, said additional work is described on Exhibit "A" attached hereto and hereby made a part hereof and plans and specifications for said additional work are on file with the City Clerk and await the approval of this Council; and WHEREAS, the funds for the completion of said additional work are currently available in the improvement fund heretofore created in proceedings pursuant to said resolution to allow for the payment of the costs of said additional work and said fund will be reimbursed to said improvement fund from other funds available to the City as hereinafter provided. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda as follows: 1. Said additional work represents a change and modification to said proceedings which will not increase the total or any individual assessment levied in said proceedings. 2. Said additional work has been requested by the owners of land assessed in said proceedings and may be ordered without further hearings into the matter. 3. Said additional work, as set forth on Exhibit "A" hereto, and the plans and specifications therefor are hereby approved. 4. Said additional work shall be paid for from funds now available in the improvement fund held by the City with respect to and pursuant to said special assessment proceedings in an amount not to exceed $500,000.00. 5. Not later than December 31, 1987, the total amount withdrawn from said improvement fund to pay for said improvements shall be reimbursed to said fund from Gas Taxes, Construction Improvement proceeds or Measure B (z(p sales tax) Fund of the City of Alameda. 6. Participant, as described in the City Cooperation Agreement dated December 8, 1984, shall not be required to satisfy Condition 1(q) of City of Alameda Planning Board Resolution No. 1695, adopted by the Planning Board of the City of Alameda on February 9, 1987, and concerning Parcel Map 4949 which was approved by action of the City Council of said City on March 4, 1987, by Resolution No. 11125, until such funds have so been reimbursed. Participant shall also be entitled to delay construction of offsite improvements described in Exhibit F of said City Cooperation Agree- ment to the extent the cost of such unconstructed offsite improvements equals the amount which has not theretofore been reimbursed by the City to the Improvement Fund after deduction of the cost of Condition 1(q). 7. Said proceedings had pursuant to said resolution of intention are hereby changed and modified in accordance with this resolution and in no other respect. EXHIBIT A MARINA VILLAGE ASSESSMENT DISTRICT 84 -3 ADDITIONAL WORK Construct Constitution Way (formerly Patton Way) within acquired right -of -way from the terminus point of Phase II, at the intersection of Eagle Avenue, to the south return of Constitution Way, at the intersection of Buena Vista Avenue. Included within this phase of the project improvements are drainage facilities, street work, and traffic signals.
